			<content:encoded><![CDATA[<p>I never thought I would find myself wistfully remembering President Clinton and wishing he were still around to inject some heart into the Oval Office (I know, I know, he may have injected some other things as well). However, after listening to President Obama&#8217;s passionless words in poignant moments over the past ten months, I now yearn to hear the oratory of President Clinton. After Obama&#8217;s reactions and comments to the Islamic massacre at Ft. Hood, I could only remember the good old days when our president inspired us and spoke passionately after a tragedy like the Oklahoma City bombing. At least when President Clinton spoke, you knew he cared about the people he addressed.</p>
<p>Obama&#8217;s poor crisis leadership skills revealed themselves in June when Abdulhakim Mujahid Muhammad murdered Private William Long outside a military recruiting center in Little Rock. Two full days passed without even a word from the president. Finally, President Obama issued a terse statement of “sadness” and never mentioned the incident again. Quite a contrast to his swift, strongly worded response and his statement of “shock” and “outrage” at the “heinous” murder of abortion doctor, George Tiller, just days before in Wichita, Kansas.</p>
<p>In August, at the funeral for Sen. Ted Kennedy, again President Obama&#8217;s coldness and aloofness raised red flags. Others, like Peggy Noonan, have also noted Obama&#8217;s cold distance as he arrived, nodded, shook hands and spoke to the family and friends of the Kennedys. In watching the funeral, I was struck by how the president could simultaneously be so completely appropriate and so emotionally vacant. He was polite to be sure, but exhibited a total absence of warmth.</p>
<p>Last week, in his remarks via telecast, at the twentieth anniversary of the fall of the Berlin Wall, President Obama recognized no other presidents before himself and also failed to mention either Margaret Thatcher or Pope John Paul II . Worse still, he failed even to utter the words “communism,” or the “Soviet Union,” or “Russia.” A major moment arrives, the president speaks, and he whiffs entirely. He exhibits no knowledge of history, no sense of poignancy or America&#8217;s contribution to the world, and no passion for the freedoms that arrived with the fall of the wall. An utterly cold and vacuous moment.</p>
<p>Finally, the Islamic massacre at Ft. Hood occurs, and President Obama&#8217;s initial instincts are to warn us all “not to jump to conclusions.” He urges us to react in direct contrast to his own hasty reaction in Gates-gate at Cambridge, and his comments there that the police “acted stupidly.” More strikingly, Obama is unable to state the simple, obvious truth: we have had another incidence of Islamic terror on our own soil. Islamic terror does not occur in a vacuum; jumping to conclusions is very different from reading the pattern of having 63 other Muslim men charged, convicted, or sentenced on terror in our own country just in 2009. Obama again totally misses the point. His trademark coolness belies a glaring ignorance of the matter at hand and his total lack of passion for the American people.</p>
<p>Worse still, his remarks at the memorial service at Ft. Hood fell flat. Does anyone remember a word he said? Years later, I can still remember the warmth and grace exhibited by President Clinton in the aftermath of Oklahoma City. In contrast, Obama&#8217;s presence and comments at Ft. Hood were utterly forgettable. He failed to show up emotionally in any way. Were one to listen to the president&#8217;s comments regarding the terror deaths of 13 Americans on an American military base at the hands of an Islamic jihadist, one would notice no difference whatsoever in modulation, tone, or posture from any other speech he has ever given. They have all begun to sound the same. He is everywhere, speaking on everything, and thereby speaking on nothing. No one listens anymore. He speaks as if he is just passing through, a mere observer on the events of life. The hollowness is unsettling.</p>
<p>All in all, Obama&#8217;s impassioned speeches are reserved for fund-raisers and for healthcare addresses, for which he has no shortage of energy. Line up a pile of dead Americans, and he can barely muster an inflection or an exclamation point. Fill the room with wealthy donors, and the man comes alive. For a mercenary, that may be an admirable thing, but for a president, the vacancy is disturbing.</p>

<blockquote><p>If you have been reading us for any length of time, you know that we used to make fun of &#8220;Dubya&#8221; nearly every day&hellip;parroting the same comedic bits we heard in our Democrat circles, where Bush is still, to this day, lampooned as a chimp, a bumbling idiot, and a poor, clumsy public speaker.</p>
<p>Oh, how we RAILED against Bush in 2000&hellip;and how we RAILED against the surge in support Bush received post-9/11 when he went to Ground Zero and stood there with his bullhorn in the ruins on that hideous day.</p>
<p>We were convinced that ANYONE who was president would have done what Bush did, and would have set that right tone of leadership in the wake of that disaster.  President Gore, President Perot, President Nader, you name it.  ANYONE, we assumed, would have filled that role perfectly.</p>
<p>Well, we told you before how much the current president, Dr. Utopia, made us realize just how wrong we were about Bush.  We shudder to think what Dr. Utopia would have done post-9/11.  He would have not gone there with a bullhorn and struck that right tone.  More likely than not, he would have been his usual fey, apologetic self and waxed professorially about how evil America is and how justified Muslims are for attacking us, with a sidebar on how good the attacks were because they would humble us.</p>
<p>Honestly, we don&#8217;t think President Gore would have been much better that day.  The world needed George W. Bush, his bullhorn, and his indomitable spirit that day&hellip;and we will forever be grateful to this man for that.</p>
<p>As we will always be grateful for what George and Laura Bush did this week, with no media attention, <a href="http://go2.wordpress.com/?id=725X1342&#038;site=hillbuzz.wordpress.com&#038;url=http%3A%2F%2Fwww.foxnews.com%2Fpolitics%2F2009%2F11%2F07%2Fgeorge-w-bush-secretly-visits-fort-hood-victims%2F">when they very quietly went to Ft. Hood and met personally with the families of the victims of this terrorist attack</a>. &hellip;</p>
<p>We hope someday to be able to thank George W. and Laura in person for all they&#8217;ve done, and continue to do.  They didn&#8217;t have to head to Ft. Hood.  That was not their responsibility.</p>
<p>The Obamas should have done that.</p>
<p>But didn&#8217;t.</p>
<p>Wouldn&#8217;t.</p>
<p>Thank goodness George W. is still on his watch, with wonderful Laura at his side.</p></blockquote>
<p>Somehow I doubt that when the current nightmare is over, anyone is going to look back with new found appreciation of the decency and patriotism of the crew we&#8217;ve got in the White House now.</p>

			<content:encoded><![CDATA[<p>I&#8217;ve been hearing some smack being talked about the Marines here, and let me tell you &#8212; the Marines are <em>THE BEST</em> team to be on for the Project Valour-IT fundraising competition.  The only real competition we have is the Army, and come on, who really thinks the Army can compete with the Marines?  But, as per tradition, the USMC team is the smallest of the group, just like they&#8217;re the smallest among the branches.  But don&#8217;t confuse the smallest with the weakest.  The Marines are the smallest branch and we&#8217;re the smallest team, but we are undoubtedly the strongest, the best trained, and the most spirited.  </p>
<p>With that said, <a href=http://www.villainouscompany.com/vcblog/archives/2009/10/10_reasons_to_j.html>here are ten reasons</a> why the Marines are the best.  OOH-RAH!</p>
<blockquote><p>1. Marines have the best uniforms, hands down. And as everyone knows, chicks really dig a guy in uniform.</p>
<p>2. Marines know how to fight. That&#8217;s why they&#8217;re called America&#8217;s 911 force:</p>
<p>In the true spirit of &#8220;jointness&#8221; I offer the following as &#8220;Everything you need to know about differences in service culture. All in good fun, of course.</p>

<p>1. Be courteous to everyone, friendly to no one.<br />

Mess nites, dinings in and out, St. Barbara&#8217;s day and the Marine Corps Ball: no one celebrates their rich history with more flair and elan than the Marine Corps. We still dress for dinner, we still pull out cigars and the smoking lamp for the men (and sometimes the ladies!).</p>
<p>We still light candles in memory of fallen comrades and those who have been wounded in the service of this nation. We do not forget. If you&#8217;ve ever been invited to a Marine Ball, don&#8217;t pass up the opportunity to attend. Those of us who have passed the quarter century mark may roll our eyes a bit, but we still go every year and still tear up when the same old passages are read. What began on November 10, 1775 in Tun Tavern is still remembered in giant ballrooms, decorated hangars, and dingy conference rooms all over this planet. Marines gather as one family to celebrate that which unites and binds us: a love of Corps, country, and above all, each other.</p>
<p>6. Esprit de corps: Which, as you should know, is no cheese-eating surrender monkey Phrench-sounding label, but something each Marine takes to heart on the day he or she finally earns the right to be called &#8220;Marine&#8221;. Every Marine is a rifleman. To call the average Marine a soldier, troop, sailor, or airman to is risk a speedy and ungentle correction. There are only Marines, an appellation which (unlike soldiers, sailors, or airmen) is always capitalized. Now *that&#8217;s* respect.)</p>
<p>7. Toughest mascot. Think about it:</p>
<p>Army: a mule<br />
Air Force: a stinkin&#8217; bird?<br />
Navy: ummm&#8230; a goat<br />
Marines: a bulldog. Nuff said.</p>
<p>8. Marine PT. Did the HVES mention that we&#8217;re just better-looking? </p>
<p>9. Marine wives. There is an old Spanish saying, &#8220;No hay rosas sin espinas.&#8221; I think it fits Marine wives well: tough, but tender; beautiful but enduring. On the day my husband finally leaves the Corps, my most precious memories will be of the officer and enlisted wives I have been privileged to work with, laugh with, cry with, and share this wacky thrill ride that is military life.</p>
<p>10. The Navy-Marine Corps team: as much as we love to rib the Navy, we couldn&#8217;t do our job without them. On any Marine base, along with green you&#8217;ll see Navy khaki. Navy corpsmen go to battle with us and dress our wounds. They are at once healers, life savers, and soldiers as tough and brave as any Marine. Navy chaplains pray with us and bury our dead. They weep with us and help us to try and make sense of the incomprehensible.</p>
<p>And it is Navy ships which carry us to distant shores so we can do what we do best: respond as America&#8217;s 9/11 force. They provide devastating firepower on target when we need it. We are proud to be a part of the sea service. But that said&#8230;.until November 11th&#8230;</p>

<p>For the Project Valour-IT competition, the Marine Corps team is doing all kind of fun stuff. We&#8217;re going to have trivia and games, and we&#8217;ll also be spotlighting Marine heroes throughout the competition. To get the ball rolling, Cassandra asked me to kick things off by interviewing <em>my</em> Marine, my boyfriend Matt. I&#8217;m ridiculously proud of him, of course, and brag about him whenever I can as it is. And as if I don&#8217;t yak about him enough on here already, I get to feature even more fun stuff about him now, too. </p>
<p>In all seriousness, Matt truly is a hero to me, just like the thousands of other Marines out there. I can say without any bias that he loves what he does, he loves the Corps, and he loves his country. He&#8217;s willing to fight and die for America and for all of us. I may be his girlfriend and I&#8217;m certainly biased, but it&#8217;s still a pretty incredible thing.</p>
<p>So, with all that said, check out Matt&#8217;s and my &#8220;interview&#8221; after the jump, and there are a few pictures of him at the end as well. (Sorry they&#8217;re all with me, too, but I don&#8217;t have many pictures of Matt in uniform that doesn&#8217;t have me in them also.)</p>

<p><strong>What is your rank and MOS in the Marine Corps?</strong></p>
<p>- Corporal, 0311 (Infantry Rifleman).</p>
<p><strong>How long have you been serving?</strong></p>
<p>- Five years, and I just reenlisted in September of 2008.</p>
<p><strong>Why did you join the Marine Corps?</strong></p>
<p>- Because it was the hardest branch, and I wanted to challenge myself. From what I saw during my time in the Army, the Marine Corps was stricter and had more rules. That was what I wanted. I also wanted to go to Iraq and fight for my country, I wanted to get deployed. I felt like everyone else was doing their part; why shouldn&#8217;t I?</p>
<p><strong>What was serving in Iraq like?</strong></p>
<p>- In the beginning, when I first got to Iraq, it was worrisome because I thought I could just be attacked at any moment and was scared of dying. But after taking mortar fire for a couple of weeks, I got used to it and wasn&#8217;t scared anymore. I knew if it was my time it was my time. All I cared about was getting home to my family, and I was more concerned about how they&#8217;d feel if I was gone. I got to see Saddam Hussein during his trial, because I was guarding the embassy in Baghdad. I got to sit in during his trial. When I came back the first time, we landed in Maine, and everyone was real friendly and really happy about us coming back. Retired Marines were coming up to us, shaking our hands, and it was great.</p>
<p>The second time I went, I was more familiar with the country and I wasn&#8217;t worried at all. We would do convoy missions, and we were in some very well protected vehicles called MRAPs (Mine Resistant Ambush Protectant), and they can take small arms fire without doing any damage. It can take a 7.62 round without penetrating the armor, and that&#8217;s the primary round of our enemy, with the AK-47s. We were worried more about IEDs, so it was like fighting a silent enemy. You can&#8217;t find them, you just hope you don&#8217;t get blown up. Most of the other Marine units on patrol got hit my IEDs, but we didn&#8217;t. We were very fortunate. But every day, when you got into your truck and started riding out, you never knew what would happen. You would get these guys coming up to you with their arms in the air yelling &#8220;ALLAH AKBAR!&#8221;, which is what they yell when they&#8217;re about to blow themselves up. So you would grab your M-16 and just get ready to shoot them if they were going to try anything. For the most part we just tried to have fun. We would pass a lot of the times doing stupid sh*t and making up dumb jokes. A bunch of us, for example, got one Marine to drink a ChemLight to see if his pee would glow. He threw up, and his pee definitely did not glow. When we got back, it was in Massachusetts. It wasn&#8217;t as great of a homecoming, because we had just returned to our own country for the first time, and no one greeted us. We were in uniform, and everyone just stared. No one smiled or said thank you or anything. You wanna talk about not feeling welcome in your own country? We didn&#8217;t feel welcome. We felt like no one cared. We got treated better in Ireland drinking beer in the airport. It was a real sh*tty homecoming, until we got back to Camp Lejeune and got to see our families and everything.</p>
<p><strong>What was the homecoming like?</strong></p>
<p>- Homecomings are always great when you have a woman there that cares about you. When I got home, my girlfriend was there waiting for me. She could&#8217;ve been standing out there for hours for all I know, but she was there when I got off the bus. The feeling of knowing that someone is going to be there waiting for you, someone who cares so much about you, made the homecoming worth something, worth more than it did the first time. That&#8217;s what every Marine wants to come home from deployment to, a good woman who&#8217;s faithful to you and who cares about you.  Also you realize you were taking for granted everything the United States has to offer before you left, especially coming back from a place like Iraq. You walk into a store and they have fresh food, fresh fruit, fresh water. In Iraq sometimes water is even hard to get.</p>
<p><strong>Do you think Americans appreciate your service?</strong></p>
<p>- I think most of them do. I always appreciate it when someone comes up to me and says thank you, but I feel more inclined to say thank you for them being supportive. There&#8217;s a lot of people who want to serve but can&#8217;t, for whatever reason. As long as they&#8217;re supportive, I&#8217;m more thankful for them than they should be for me, personally.</p>
<p><strong>There are some people, especially on the Left, who don&#8217;t support the military. How do you feel about that?</strong></p>
<p>-They have the right to say what they want. They&#8217;re Americans, and that&#8217;s their right. Of course, the only reason they have that right is because the military [is] willing to fight for it. They can put it down all day long and sit around at home being a coward, but at the end of the day, it&#8217;s thanks to the military that they can put us down. It&#8217;s thanks to the military that they aren&#8217;t speaking Japanese or German or Russian. </p>
<p><strong>What does being a Marine mean to you?</strong></p>
<p>- Being a cut above the rest. It&#8217;s not always about physical ability, sometimes it&#8217;s more mental. It sounds cliched, but it&#8217;s the whole &#8220;the few&#8230; the proud&#8221; thing. We&#8217;re very proud of who we are because of our training. I feel like we get better training than any other branch. </p>
<p><strong>What about America is worth fighting for to you? The Marines have been known as the best fighting force the world has ever seen, but what is it that you are actually fighting for?</strong></p>
<p>- Opportunity. People have more of an opportunity here than in other countries. It is a country that&#8217;s been through some hard times, but so have a lot of countries. What makes this country so great is&#8230; you can call it freedom, but it&#8217;s not what people usually think. It&#8217;s not the freedom to do whatever you want. The freedom to have a job, to raise a family, to not have a communist dictator running your life. The freedom to speak up and not have repercussions from your government, with them dragging you outside your house and shooting you, or raping your wife right in front of you. People like to put down this country, but it&#8217;s a lot better than most other countries. It&#8217;s a melting pot. If it&#8217;s so bad here, then why do so many other people leave their countries to come live in the United States? I fight for the Constitution. The Constitution was made for the United States, for the people, by the people. A document was signed that freed Americans from tyranny, and I&#8217;m not fighting for the president or my mom or my girlfriend. I fight for the Constitution, I fight for everybody.</p>
<p><em>Some people wonder all their lives wondering if they made a difference. The Marines don&#8217;t have that problem.</em></p>

<p>October 26th the <a href=http://soldiersangels.org/index.php?page=project-valour-it>Project Valour-IT</a> fundraiser kicks off.  And while the Marines are the smallest group, we&#8217;re the toughest and the most spirited.  Here&#8217;s the info from the Marine Corps team leader, <a href=http://www.villainouscompany.com/vcblog/archives/2009/10/join_the_ateam.html>Cassandra from Villainous Company</a>:</p>
<blockquote><p>Who does America call when something absolutely, positively must be destroyed overnight?</p>

<p>That&#8217;s right&#8230; America&#8217;s 911 Force: the Few. The Loud. <a href="http://soldiersangels.org/index.php?page=join-marines-team" target="_blank">The Marine team!</a></p>
<p>We&#8217;re still looking for a few good blogs to help us raise money for Project Valour IT. The competition starts Monday, October 26th and though the Marines are the smallest service, we&#8217;re planning to chew through the competition. But to do that, we need your help.</p>
<p>Project Valour IT provides laptops with voice activated software to wounded soldiers, sailors, Marines and airmen at Walter Reed and Bethesda. Typically these young men and women spend up to two years recovering and undergoing physical therapy. Their <a href="http://www.onemarinesview.com/one_marines_view/2009/07/healing-with-humor.html" target="_blank">courage, determination, and unfailing esprit de corps</a> are truly inspiring. Most of us, facing the loss of our eyesight, an arm or a leg and repeated surgeries would just crumble up into a ball. Not these guys. They&#8217;re warriors:</p>
<blockquote><p>He knows they&#8217;re going to stare. They always stare.</p>
<p>As soon as Pat Murray steps in the elevator, they&#8217;ll notice his prosthetic leg and maybe accurately surmise that, yes, he is an Iraq war veteran, and, yes, he got blown up. Then the sadness will sink in, the pity, and they&#8217;ll give him that look, which he can sense even if he doesn&#8217;t see, and it will be an uncomfortable few floors up.</p>
<p>So as Murray approaches the elevator and the woman thrusts her hand between the closing doors for him, he says, &#8220;Careful, you can lose a limb that way.&#8221;</p>
<p>&#8220;Oooh,&#8221; the woman says, noticing Murray&#8217;s metal leg. She&#8217;s obviously shocked, unsure of what to say or how to act. Murray flashes a smile, lets loose an &#8220;it&#8217;s okay&#8221; chuckle, and suddenly the ride up isn&#8217;t nearly so awkward after all.</p>
<p>It&#8217;s that type of humor &#8212; spontaneous (he once asked his doctor when his leg would grow back), cunning (he tells children who ask about his &#8220;robot&#8221; leg that he didn&#8217;t eat his vegetables) and, at times, gruesome (there are stump jokes that can&#8217;t be printed here) &#8212; that helped him come to terms with the fact that his right leg is no more.</p>
<p>It was at Walter Reed Army Medical Center that Murray, who was a corporal in the Marine Corps, not only learned to walk again, but to laugh. Although doctors and therapists can patch up the physical wounds of war, it is often the humor &#8212; soldier to soldier, Marine to Marine, patient to patient &#8212; that in the space of a punch line can heal as well as the best medicine.</p></blockquote>
<p>It&#8217;s not unusual for these young men and women to take up bungee jumping, skydiving, or participate in marathons or other extreme sports even after losing a limb. But that long period where they&#8217;re confined to their hospital beds can be the worst of all. Project Valour IT provides them with a way to escape the confines of their rooms and keep in touch with buddies, friends and family members. For many wounded vets, it&#8217;s a tangible reminder that they&#8217;re still part of the world outside Bethesda or Walter Reed: that there is life after being wounded.</p>
<p>Valour IT is one of my favorite military charities. I&#8217;ve supported it every year and led the Marine Team to raise over $51,000 in 2006. My co-captain Carrie and I are planning two weeks of fun, jokes, Marine history, culture, heroes and more. Carrie&#8217;s son is headed over to Afghanistan and my husband is already over there, so we both have good reason to support <a href="http://soldiersangels.org/index.php?page=history-of-project-valour-it" target="_blank">the great work Valour IT is doing</a>. </p>

<p><img vspace="10" hspace="10" border="0" align="right" src="http://www.publiusforum.com/images/ed_chen.jpg" />President Obama has gone out of his way to &#8220;diversify&#8221; the federal bench with his spate of nominations of various minorities chief of which was his successful seating of the &#8220;wise Latina,&#8217; Sonia Sotomayor, on the Supreme Court. Obama&#8217;s nominees* for 10 district court openings include four African-Americans, three Asian-Americans, one Latino and four women. One of those nominees, San Francisco U.S. Magistrate Judge Edward Chen, <a href="http://www.mercurynews.com/breaking-news/ci_13568546">received a favorable vote</a> in the Senate Judiciary Committee in Washington today.</p>
<p>So what sort of judge is Edward Chen? Well, for one, the left-wing American Bar Association rated Chen a &#8220;well qualified&#8221; nominee and many of his associates at the ACLU speak highly of him. As an ACLU lawyer, Chen was known for opposing English-only policies and for pushing discriminatory affirmative action ideals. He even came to the aid of gang members in one case. Chen was quite the ACLU activist between 1979 and 2001.</p>
<p>His ACLU history would suffice to make many wary of him, of course. But for a segment of America, working for the ACLU is not a disqualifier. So in order to judge Edward Chen one must look at his past. Discovering what Judge Chen thinks of the country upon which he apparently assumes to sit in judgment is a telling exercise. Sadly, it seems he has quite a low opinion of the nation that he will be serving.</p>
<p>One hint at Judge Chen&#8217;s feelings about our nation can be seen from his appearance at the 2005 graduation ceremony at the Hastings Public Interest Law Foundation. There, Chen wondered aloud if American patriotism was justified. Chen told the crowd of his, &#8220;feelings of ambivalence and cynicism when confronted with appeals to patriotism &#8212; sometimes I cannot help but feel that there are too much [sic] injustice and too many inequalities that prevent far too many Americans from enjoying the beauty extolled in that anthem.&#8221; Apparently, Chen feels that America is too racist to justify anyone feeling patriotism for her.<br />

<p>In fact, racism seems to be one of Chen&#8217;s major concerns and he sees it everywhere. Immediately after the attacks on 9, 11, 2001 Chen&#8217;s first thoughts were about racism but not that of the Arabs that sent over three thousand Americans to their deaths. No, as soon as Chen learned of the attacks of 9/11 Chen&#8217;s first worry was that white Americans were going to use their racism to justify racist attacks on Muslims and anyone else that got in their way.</p>
<p>Only ten days after 9/11 occurred, Chen remarked that he imagined that America would revert to the &#8220;irresistible forces of racism, nativism and scapegoating&#8221; of the past and begin systematic oppression of American Muslims. Later he likened America&#8217;s post 9/11 military and security policies to the climate that led up to Japanese internment during WWII. In fact, he seemed to imagine that &#8220;a thousand Americans&#8221; were being swept up and held in secret prisons right after 9/11.</p>
<p>In a speech given at the Operation Protect and Defend dinner on May 4, 2006, Judge Chen referred to &#8220;secret surveillance of Americans without a judicial warrant, secret no fly lists, [and] secret detention of nearly a thousand American residents held without charges.&#8221; Naturally, he offered no proof of this wholesale but secret detention of Americans.</p>
<p>Chen also saw racism in the aftermath of Hurricane Katrina in 2005, as well. Chen charged that the reason that New Orleans had so much trouble after the storms passed was because the inhabitants of the Crescent City were black. &#8220;Institutionalized racism&#8221; caused the federal government&#8217;s supposedly slow response to the crisis there, Chen said. At the Diversity Celebration of the California State Bar Convention in 2005, <a href="http://74.125.93.132/search?q=cache:kU-GjI6dNWkJ:www.vcba.org/citationsmag/2005/05oct.pdf">Chen asked the audience</a>, &#8220;Would the response have been different had the majority of victims been white and middle class rather than poor and black?  Would the response have been quicker had it been Kennebunkport instead of New Orleans?&#8221;</p>
<p>Racism again came to vex Chen&#8217;s overactive imagination in the aftermath of the Virginia Tech shootings perpetrated by an Asian man. Chen&#8217;s fevered imagination dreamed up images of Asian men being discriminated against all across the country because of the actions of one mentally unstable nut. In comments before the Asian Pacific Americans in Higher Education Conference, Chen worried that Asians would be the &#8220;subject of a racial backlash, victimized&#8221; by hate crime.</p>
<p>It is apparent that Edward Chen does not find much to celebrate about the United States. The whole country is so filled with &#8220;injustice&#8221; and &#8220;inequalities&#8221; that only a crusading judge can right the wrongs.</p>
<p>Now, what of his judicial standards? What sort of philosophy does Chen employ on the bench? Is it a strict standard of reading at law, or is he one of those sorts of judicial activists that uses the law to spread his own particular philosophy of social justice? Sadly, it appears to be the later. At least one can be excused to think this from a 2003 article Chen wrote entitled “The Judiciary, Diversity, and Justice For All” published in the California Law Review.</p>
<p>&#8220;&#8230;diversity enhances the quality of decision-making. . . . judges have to make determinations that draw not so much upon legal acumen, but on an understanding of people and of human experiences.  Such experiences inform assumptions that affect legal decisions.  At trial and in evidentiary hearings, judges have to assess the credibility of witnesses.  A witness’ testimony may seem more credible if it is consistent with the judge’s knowledge or experience, and, conversely, less credible if it remains outside the judge’s experience. . . . Simply put, a judge’s life experiences affect the willingness to credit testimony or understand the human impact of legal rules upon which the judge must decide.  These determinations require a judge to draw upon something that is not found in the case reports that line the walls of our chambers.  Rather judges draw upon the breadth and depth of their own life experience, upon the knowledge and understanding of people, and of human nature.  And inevitably, one’s ethnic and racial background contributes to those life experiences.&#8221;</p>
<p>Of course, this attitude seems to register well with Obama&#8217;s views of &#8220;judicial empathy.&#8221; In this view the law is heavily influenced by the judge&#8217;s &#8220;feelings&#8221; and those feelings are at least as important as the written law. This also matches well with Sotomayor&#8217;s ideas that her status as a Latina made her more qualified than an old white man to be a judge. For Obama&#8217;s judges, experiences and feelings trump the Constitution and the law and these experiences and feelings should be used as a basis to adjudicate the cases that come before them.</p>
<p>In Chen&#8217;s case we can see that the main influence on his judicial philosophy is an inordinate fear of racism. He sees it under his bed, in his closet, in the faces of everyone he meets. With this penchant in mind, can Chen honestly, dispassionately, and seriously serve effectively as a federal judge? One cannot help but wonder if his preoccupation with envisioning racism in every situation makes Judge Chen ill-suited for the federal bench where a dispassionate mien is required. It is easy to see that his constant resorting to charges of racism will likely color every decision he delivers.</p>
<p>Judge Chen will bring &#8220;diversity&#8221; to the bench as President Obama wants certainly. But will he also bring divisiveness and a desire to get even with all the racism he sees where ever he looks? His record hints that he just might.</p>

The four Asian-American nominees would increase by 36% the number of Asian-American judges. They include Southern District of New York Judge Denny Chin, who would be the first Asian-American judge on the U.S. Court of Appeals for the 2d Circuit; California Superior Court Judge Jacqueline Nguyen, who would be the first Vietnamese-American district judge; and Magistrate Judge Edward Chen, who would be the first Asian-American member of the Northern District of California. <p>Jim Clausen flies the American flag from the back of his motorcycle. He has a son in the military heading back to Iraq, and the flag &#8211; he said &#8211; is his way of showing support.  &#8220;This flag stands for all those people,&#8221; said Clausen, an Oaks Apartment resident. &#8220;It stands for the people that can no longer stand &#8211; who died in wars. That&#8217;s why I fly this flag.&#8221;</p>
<p>But to Oaks Apartment management, Clausen said, the American flag symbolizes problems.  He was told to remove the red, white and blue from both of his rides, or face eviction.  &#8220;It floored me,&#8221; he said. &#8220;I can&#8217;t believe she was saying what she was saying.&#8221;</p>
<p>Even long-time residents like Sharron White, who has flown a flag on her car for eight years, has been told to take it down.  White said management told her that &#8220;someone might get offended.&#8221;  &#8220;I just said to her &#8216;They&#8217;ll just have to get over it,&#8217;&#8221; White said.</p>
<p>Residents we talked to who had been approached to take down their flags all told us the same thing: that management told them the flags could be offensive because they live in a diverse community.</p>
<p>Attempts to find out for ourselves why management would ban flags were unsuccessful. KATU wanted to talk to management at Oaks Apartments, but no one has returned our calls. The woman we were told had made the decision said she was &#8220;not going to answer any questions.&#8221;</p>
