Even some moonbats are getting unnerved by the Obamination Administration’s intrusiveness, hyper-politicization of the media, and aggressive contempt for the First Amendment:

In a case that raises questions about online journalism and privacy rights, the U.S. Department of Justice sent a formal request to an independent news site ordering it to provide details of all reader visits on a certain day.

The grand jury subpoena also required the Philadelphia-based Indymedia.us Web site “not to disclose the existence of this request” unless authorized by the Justice Department, a gag order that presents an unusual quandary for any news organization.

Kristina Clair, a 34-year old Linux administrator living in Philadelphia who provides free server space for Indymedia.us, said she was shocked to receive the Justice Department’s subpoena. (The Independent Media Center is a left-of-center amalgamation of journalists and advocates that — according to their principles of unity and mission statement — work toward “promoting social and economic justice” and “social change.”)

The subpoena (PDF) from U.S. Attorney Tim Morrison in Indianapolis demanded “all IP traffic to and from www.indymedia.us” on June 25, 2008. It instructed Clair to “include IP addresses, times, and any other identifying information,” including e-mail addresses, physical addresses, registered accounts, and Indymedia readers’ Social Security Numbers, bank account numbers, credit card numbers, and so on.

Clair turned to the Electronic Frontier Foundation, which dug into whether Big Government is supposed to be able to behave like this.

Under long-standing Justice Department guidelines, subpoenas to members of the news media are supposed to receive special treatment. One portion of the guidelines, for instance, says that “no subpoena may be issued to any member of the news media” without “the express authorization of the attorney general” — that would be current attorney general Eric Holder — and subpoenas should be “directed at material information regarding a limited subject matter.”

Still unclear is what criminal investigation U.S. Attorney Morrison was pursuing. Last Friday, a spokeswoman initially promised a response, but Morrison sent e-mail on Monday evening saying: “We have no comment.” The Justice Department in Washington, D.C. also declined to respond.

Kevin Bankston, a senior staff attorney at the San Francisco-based Electronic Frontier Foundation, replied to the Justice Department on behalf of his client in a February 2009 letter (PDF) outlining what he described as a series of problems with the subpoena, including that it was not personally served, that a judge-issued court order would be required for the full logs, and that Indymedia did not store logs in the first place.

Morrison replied in a one-sentence letter saying the subpoena had been withdrawn. Around the same time, according to the EFF, the group had a series of discussions with assistant U.S. attorneys in Morrison’s office who threatened Clair with possible prosecution for obstruction of justice if she disclosed the existence of the already-withdrawn subpoena…

For more info on this alarming example of applied Obamunist Transparency:

Bankston has written a longer description of the exchange of letters with the Justice Department, which he hopes will raise awareness of how others should respond to similar legal demands for Web logs, customer records, and compulsory silence. “Our fear is that this kind of bogus gag order is much more common than one would hope, considering they’re legally baseless,” Bankston says. “We’re telling this story in hopes that more providers will press back and go public when the government demands their silence.”

Hopefully liberals who believe in at least some of the fundamental principles of liberty that make America America, will awaken soon to the nature of what they have wrought by allowing the Moonbat Messiah and his gang of sleazy neo-Marxists into the White House.

Can we just get this entire organization outlawed already? This isn’t just a few bad apples, the whole bunch is done spoiled.

An internal review by the board of directors of the community organization ACORN determined that the amount allegedly embezzled from the community organization was $5 million, well more than the previously reported amount of nearly $1 million, according to a new subpoena in an investigation by Louisiana Attorney General Buddy Caldwell.

The subpoena, released this afternoon, says, “It is still unclear if some of the monies embezzled are from state, federal or private funds.”

ACORN Chief Executive Officer Bertha Lewis said the new accusation about the embezzlement is “completely false.” She said she would comment further after she and ACORN attorneys have a chance to review the subpoena.

Caldwell issued subpoenas in August seeking documents related to Acorn International then-President Wade Rathke and his brother Dale Rathke, who kept the group’s books. Those subpoenas were focused on possible Acorn violations of state employee tax law, obstructing justice and violating the Employee Retirement Security Act.

One reason Comrade Obama and the ultra-left leadership in Congress have shown such open contempt for the consequences their extreme agenda will have at the polls is they have been counting on their foot soldiers in ACORN to tilt the balance with operations like this:

Dozens of forged and fraudulent absentee ballots from people registered to vote on the Working Families Party line were filed in the Sept. 15 primary elections in Troy [New York], the Times Union has learned.

Many of the questionable ballots were filed under the names of students and people who live in government-subsidized housing and other downtown areas. Still others were submitted on behalf of voters who were alleged to have signed the ballots earlier this month, but those people have not lived in New York state for at least a year, records show.

Documents at the county Board of Elections show the fraudulent ballots were handled by or prepared on behalf of various elected officials and leaders and operatives for the Democratic and Working Families parties.

As the Times Union doesn’t bother to note:

The Working Families Party is not about working people or families and it isn’t really a party. The WFP is a wholly owned subsidiary of ACORN. Bertha Lewis co-chair of the Working Families Party is the Executive Director of New York ACORN. New York ACORN leader, Steven Kest was the moving force in forming the party and WFP headquarters are located at the same address as ACORN’s national and New York office at 88 Third Avenue in Brooklyn, New York.

WFP is essentially a money funnel which pays for an aggressive door to door canvas. Largely funded by unions, the WFP is ACORN’s “political arm” in New York State. Candidates supported by the Working Families Party and issues supported by ACORN are both advocated on the door steps of target voter homes as they share one major voter canvas.

This would be the same ACORN Obama surreptitiously paid $800,000 for election services during the 2008 campaign.

In the aftermath of the O’Keefe/Giles videos, the Senate voted 83-7 to limit the torrent of taxpayer money flooding into ACORN’s coffers. This means nothing. WFP is just one of literally hundreds of front groups ACORN hides behind.

Nothing short of a RICO investigation will rid the country of this rapidly metastasizing cancer. Good luck getting one past the Attorney General with the former Senator From ACORN residing in the White House. If our rulers would be brazen enough to kill an investigation into Black Panther goons intimidating voters at the polls, the odds of them digging up ACORN by the roots are nil. The same corrupt thugs indulging in the same crimes will continue to wallow in our money under different names.

After intimidating voters at a Philadelphia polling precinct, decked out like military thugs from a third world country, wielding at least one 2-ft. long nightstick, a civil lawsuit was filed. The three men charged refused to show up for their court cases for five months – that’s 5 months – and they did show! The government won a default judgment in federal court against the New Black Panthers and three of their men. In April, however, department lawyers were told to drop the case – after already procuring the default judgment. Unbelievable.

Why would the case be dropped? Wouldn’t you know it is always about politics?

Front-line lawyers were in the final stages of completing that work when they were unexpectedly told by their superiors in late April to seek a delay after a meeting between political appointees and career supervisors, according to federal records and interviews.

If that doesn’t make your blood boil…this will:

Justice Department spokeswoman Tracy Schmaler told The Washington Times that the department has an “ongoing obligation” to be sure the claims it makes are supported by the facts and the law. She said that after a “thorough review” of the complaint, top career attorneys in the Civil Rights Division determined the “facts and the law did not support pursuing the claims against three of the defendants.

Schmaler is certainly a Liberal. She had the audacity to say “we [DOJ] are committed to vigorous enforcement of the laws protecting anyone exercising his or her right to vote.” Only Liberals have that special kind of audacity. What about the people of Philadelphia? What about the people inside and outside the polling place? What about Mr. Bull – a man who signed an affidavit telling what he saw that day?

Schmaler says claims must be supported by facts and the law. How about the default judgment? But beside that, there was a witness with a sworn affidavit. He is a “longtime civil rights activist and a former aide to Senator Robert F. Kennedy’s 1968 presidential campaign. Here is a portion of Bartle Bull’s affidavit:

In my opinion, the men created an intimidating presence at the entrance to a poll,” he declared. “In all my experience in politics, in civil rights litigation and in my efforts in the 1960s to secure the right to vote in Mississippi … I have never encountered or heard of another instance in the United States where armed and uniformed men blocked the entrance to a polling location.

Can you believe that the DOJ never did get around to entering Mr. Bull’s affidavit! I know it is drama to say that I want to cry for this country and for my children, but that is how I feel. This is not justice. Where is the ACLU on behalf of the American voter?

The guilty are Acting-Assistant Attorney General Loretta King, appointed by Barack Obama, who delayed the case. Then King discussed it with Associate Attorney General Thomas J. Perrelli. He accepted the counsel of King:

She and other career supervisors ultimately recommended dropping the case against two of the men and the party and seeking a restraining order against the one man who wielded a nightstick at the Philadelphia polling place. Mr. Perrelli approved that plan, officials said.

Rep. Frank R. Wolf (F-VA), a senior member of the House Appropriations Committee was prevented from interviewing the “front-line” lawyers who brought the charges. That’s transparency for you!

Why am I being prevented from meeting with the trial team on this case? Mr. Wolf asked. “There are many questions that need to be answered. This whole thing just stinks to high heaven.

Yes, it stinks to high heaven, as most everything does connected to this administration. No need to worry, however, Wolf can’t get anywhere with it, but Rep. John Conyers (D-MI) has some pull and he is meeting with King next week. Rep. Lamar Smith (R-TX) is also to be allowed in the door. More from Rep. Wolf:

If showing a weapon, making threatening statements and wearing paramilitary uniforms in front of polling station doors does not constitute voter intimidation, at what threshold of activity would these laws be enforceable? Mr. Wolf asked.

Here’s a quote from the U.S. Commission on Civil Rights:

…in a June 16 letter to Justice that the decision to drop the case caused it “great confusion, since the NBPP members were “caught on video blocking access to the polls, and physically threatening and verbally harassing voters during the Nov. 4, 2008, general election.

Though it had basically won the case, [through default] the [Civil Rights Division] took the unusual move of voluntarily dismissing the charges , the letter said. “The division’s public rationale would send the wrong message entirely — that attempts at voter suppression will be tolerated and will not be vigorously prosecuted so long as the groups or individuals who engage in them fail to respond to the charges leveled against them.

To date, the Washington Times says their request for records under the Freedom of Information Act (FOIA) has yielded nothing.

AG Thomas Perrelli, whose word was the final decision, raised more than $500,000.00 for Obama for the presidential election.

I cannot begin to express my high-volume anger right now.

The New Black Panthers are identified as the party’s chairman, Malik Zulu Shabazz, an attorney and a D.C. resident. The nightstick bully is alleged to be Minister King Samir Shabazz, of Philadelphia and head of the Philadelphia NBPP chapter; and Jerry Jackson, Philadelphia. The people of Philadelphia were subject to a thug from Washington, D.C.! The suit against these men alleged:

The civil suit filed Jan. 7 identified the three men as members of the Panthers and said they wore military-style uniforms, black berets, combat boots, battle-dress pants, black jackets with military-style insignias and were armed with “a dangerous weapon”and used racial slurs and insults to scare would-be voters and those there to assist them at the Philadelphia polling location on Nov. 4.

The complaint said the three men engaged in “coercion, threats and intimidation, … racial threats and insults, … menacing and intimidating gestures, … and movements directed at individuals who were present to vote.” It said that unless prohibited by court sanctions, they would “continued to violate … the Voting Rights Act by continuing to direct intimidation, threats and coercion at voters and potential voters, by again deploying uniformed and armed members at the entrance to polling locations in future elections, both in Philadelphia and throughout the country.”

In case you are not white with anger…yet, one more reminder: these men never did respond to the charges or appear in court. Could you get away with this? I could not.

The New Black Panthers in Philadelphia want us to know how responsible and credible they are. They’ve “suspended” their chapter in that city “until further notice.” No elections to abuse coming up any time soon. Time to hit the streets and abuse someone there, or meet-up with ACORN for a little fun at the expense of voters everywhere. And what about Malik zulu Shabazz, who called Michelle Malkin a “political prostitute” – all cozy back home in Washington, D.C. where voters need no abuse to do the bidding of the New Black Panthers.

In the photo above, King Samir Shabazz (L) and Jerry Jackson (R), both of Philadelphia. See them all in the video below.

Mr. Conyers, Michigan Democrat, earlier bucked his party leaders by calling for hearings on accusations the Association of Community Organization for Reform Now (ACORN) has committed crimes ranging from voter fraud to a mob-style “protection” racket.

Evidently “powers that be” is a reference to Chairman Zero, who worked with ACORN to coerce banks into giving race-based mortgages (thus helping bring about the financial crisis), and who plans to use the ACORN thugs he personally trained to create phony numbers for the 2010 Census, which will result in more Congressional seats for Democrats, and more taxpayer $billions showered upon BHO’s Dumpster-dwelling base. The word “corrupt” doesn’t even begin to describe the Obamination regime.

Too bad for Conyers he can’t kill investigations into the behavior of his wife Monica, Detroit City Council President Pro Tem, who has pleaded guilty to felony bribery. But compared to what’s going on in the District of Criminals, the Conyers’ malfeasance is hardly worth mentioning.

-By Warner Todd Huston

Remember the hue and cry that went up when President Bush fired some U.S. attorneys in 2006? Oh, the left was beside itself about how eeeevil it was that Bush was to fire so many U.S. Attorneys… even though he had the authority to do so. Charges that the firings were made for “political reasons” were thrown about and Congressional Democrats clamored for new laws and the head of Bush’s Attorney General on a pike.

Well, last night, clearly for political reasons, Barack Obama tried to fire AmeriCorps inspector general, Gerald Walpin. Not only is it for strictly political reasons (Short take: “the AmeriCorps IG accuses prominent Obama supporter of misusing AmeriCorps grant money. Prominent Obama supporter has to pay back more than $400,000 of that grant money. Obama fires AmeriCorps IG.”) but Obama does not have the authority to summarily dismiss an IG as he tried to do last night.

Will the left ring the claxon clang of how illegitimate the president’s actions are this time? Should we hold our breath?

Last night, Obama’s office sent a terse note to IG Walpin stating that he had one hour to resign or he’d be fired. Walpin alerted Congress and asked what he should do because he knew that his position wasn’t solely at the discretion of the president. He knew that he answered to both the president and Congress.

So, what is this Inspector General position, how does it work? To answer that we go to Byron York’s piece in the Washington Examiner.

Inspectors General are part of every federal department. They are given the responsibility of independently investigating allegations of waste, fraud, and corruption in the government, without fear of interference by political appointees or the White House. Last year Congress passed the Inspectors General Reform Act, which added new protections for IGs, including a measure requiring the president to give Congress 30 days prior notice before dismissing an IG. The president must also give Congress an explanation of why the action is needed. Then-Sen. Barack Obama was one of the co-sponsors of the Act.

Notice that York reports that Obama is supposed to give a 30 day notice to Congress before an IG is removed? Yet, last night in what should be seen as an entirely arrogant move, Obama tried to fire an IG not with 30 days notice, but one hours notice!

According to York, it has also been pretty much assured that this firing was for political purposes, too.

More information now, from the Associated Press. The White House is going ahead with firing Walpin. The firing apparently stems from Walpin’s investigation of a non-profit group, St. HOPE Academy, run by Kevin Johnson, the former NBA star who is now mayor of Sacramento, California (and a big Obama supporter). “[Walpin] found that Johnson, a former all-star point guard for the Phoenix Suns, had used AmeriCorps grants to pay volunteers to engage in school-board political activities, run personal errands for Johnson and even wash his car,” the AP reports. In April, the U.S. attorney declined to file any criminal charges in the matter and criticized Walpin’s investigation. But at the same time Johnson and St. HOPE agreed to repay about half of the $850,000 it had received from AmeriCorps.

Bottom line: The AmeriCorps IG accuses prominent Obama supporter of misusing AmeriCorps grant money. Prominent Obama supporter has to pay back more than $400,000 of that grant money. Obama fires AmeriCorps IG.

Here is some more background on the misuse of AmeriCorps funds that York was referring to.

Obama is perpetrating a purely illicit action by trying to fire this IG without following the rules and without consulting with Congress. In fact this is worse than Bush’s firings of the U.S. attorneys in 2006 because in that case, Bush at least had the authority to do so — whether it was a good political move or not. Here, it seems Obama clearly does not have such authority.

I’d say that this is a supremely arrogant move on Obama’s part. Will he be called on it?

(It should also be noted that both Carter and Clinton fired many U.S. attorneys in their day. Clinton fired all of his at one time during his tenure in the White House.)

You know liberals like what you’ve done when they bestow upon you their ultimate honor: victim status. Take Debra Gindorf, for example. Lots of women kill their kids in the womb, or halfway outside the womb, but Gindorf killed her son and daughter when they were 3 and 23 months, respectively.

Back in the 1980s, the justice system was insensitive enough to sentence her to life without the possibility of parole. But until murderers have been executed, there’s no guarantee that liberals won’t set them free — which Illinois Governor Pat Quinn has now done for Gindorf.

Moonbat activists are “ebullient” about this travesty of justice. According to their ideology, the dead children aren’t the victims — Gindorf is. After her trial had finished, someone got the idea that she had been oppressed by postpartum depression — i.e., by motherhood itself. Like Andrea Yates, who has been publicly idolized by MSM princess Katie Cupcake, this granted Gindorf a license to kill.

Bobby Rush, the former Black Panther militant who is now a Congressman and prominent advocate of Cuban-style communism and repealing the Second Amendment, is also a big fan of “postpartum-awareness issues.” He crows that Gindorf’s release is

a significant step in recognizing some of the important issues as they relate to new mothers’ health.

Murdering your own children is now a “health” issue even after the children have been born. Down the slippery slope to hell on earth we go.

Lila Rose has caught Planned Parenthood breaking the law across the country — so far, in three states. She also caught them practicing the kind of racism and eugenics that would make Planned Parenthood founder Margaret Sanger proud. (You can see Lila Rose’s undercover history with Planned Parenthood here).

Now, we’ve got a sixth scandal from Lila Rose and Live Action Films, this time in Memphis, TN. In this video, she poses as a fourteen-year-old impregnated by a thirty-one-year-old. In Tennessee, that is a felony, and health professionals are required by law to report suspected sexual abuse to law enforcement immediately.

What do you think the Memphis Planned Parenthood staffer did?

From the press release:

A counselor at a Planned Parenthood clinic in Memphis, TN was caught on hidden camera coaching a 14-year-old girl to lie to a judge so he would not find out about her 31-year-old boyfriend and the girl could obtain a waiver for an abortion without her parents’ knowledge. This is the sixth Planned Parenthood clinic implicated in a developing multi-state child abuse scandal involving the deliberate suppression of evidence of statutory rape.

Lila Rose, 20-year-old UCLA student and president of the nonprofit Live Action, entered Planned Parenthood’s Memphis Health Center undercover and told a counselor that she was 14 years old, pregnant by her 31-year-old “boyfriend”, and needed a secret abortion so her parents would not find out about her sexual relationship with the older man. Tennessee Code 37-1-605 requires health professionals to report suspected cases of sexual abuse of minors to law enforcement immediately.

… The new video marks the fifth in Live Action’s “Mona Lisa Project,” a nationwide undercover investigation that documents Planned Parenthood’s repeated noncompliance with state mandatory reporting laws for sexual abuse of minors. Tennessee is the third state to be implicated in the controversy, along with Arizona and Indiana.

“This is the sixth clinic we have recorded that manipulates the law and covers up sexual abuse. Planned Parenthood’s abortion-first mentality makes it operate as an advocate for terrible crimes against children,” Rose states. “What more do authorities need to see before holding this organization accountable for its institutionalized indifference to statutory rape and sexual abuse of children?”

There are six videotaped cases of Planned Parenthood breaking the law in three states, plus one recorded conversation in California. The only state to start any kind of investigation into Planned Parenthood was Indiana. I don’t know what more to say that I haven’t already said. Planned Parenthood is a taxpayer-funded organization, people. They receive over $300 million of our money every year. And this is what they’re doing with that money. This has gone beyond mere coincidence. Yet we continue to look the other way. Planned Parenthood should have to face the legal consequences of what they are doing, but at a bare minimum, the taxpayer funding should stop immediately.

Covering up the sexual abuse of children is evil. Planned Parenthood is showing over and over and over again that they are perfectly fine with doing just that. Perhaps it’s time to take action, folks. Let’s start with Tennessee.

Call the following Tennessee congressmen and senators and ask them about this issue. Also call the Tennessee governor. Be polite. Ask them if they would support an investigation of Planned Parenthood based on this information and if so, will they take action to initiate one. These videos mean nothing if we do not take action, so let’s stand up together. Lila Rose can’t do everything; it’s our responsibility, too.

Catch and let go seems to be the new policy for illegals. Napolitano Frees 27 Illegal Immigrants, Sends Them Back to Work

The Department of Homeland Security freed 27 illegal immigrants arrested during a workplace raid in February and offered them legal work permits, signaling a major departure from the immigration enforcement policy of the Bush administration.

The Feb. 24 raid of an auto parts plant in Bellingham, Wash., netted 28 illegal immigrants. While one was deported, the remaining workers were released from custody and given employment authorization documents, or EADs, in exchange for cooperating with an ongoing investigation of their employer, Yamato Engine Specialists.

The EAD is a temporary work permit most commonly given to people applying for green cards or citizenship. It usually lasts for one year, but Immigration and Customs Enforcement sources tell FOX News that these work permits will expire when the case against Yamato is closed.

Immigrant rights activists support the move and the new direction Secretary Janet Napolitano is taking the Homeland Security Department with her focus on penalizing employers rather than the immigrants themselves. “She is crafting and the people in her department are crafting a strategy that could target some people who are abusive and manipulative as employers,” said Pramila Jayapal, executive director of the Seattle-based immigrant aid group OneAmerica.

But critics say the softened policy will increase the number of illegal immigrants entering the country. “The signal that it sends to illegal immigrants is that if you can get here, you’re pretty much home free,” said Ira Mehlman, a spokesman for the Federation for American Immigration Reform.

The Bellingham raid was the first and only mass arrest of immigrants since President Obama took office and came as a shock to Napolitano, who ordered a review of the incident the day after. “I didn’t know about it beforehand,” she told the House Homeland Security Committee the morning following the raid. “I want to get to the bottom of this as well.”

The response from the Department of Homeland Security marks a major shift from the last years of the Bush administration, when workplace arrests of illegals were commonplace. Criminal arrests of employers who hired illegal immigrants skyrocketed from 25 in 2002 to 1,103 in 2008. The number of deportations jumped from 485 to 5,184 over that same time period. The Obama administration has sought a freeze on immigrant arrests.

Enforcement advocates say Americans should be outraged by the government giving illegal immigrants a right to work when unemployment is so high for documented workers. Unemployment in Whatcom County, home to the Yamato plant, has risen to 8.1 percent, and in the days after the Yamato raid, more than 150 people applied for the jobs made open by the arrests.

Immigrant groups say the release was a humane act that is keeping families together and allowing them to earn a decent living. Secretary Napolitano is expected to soon formally announce new guidelines for workplace immigration enforcement.
