Note the Web domain of the press release, governor.mo.gov. This is not “someone’s blog,” a “rumor,” or a “smear.” It is the official Web site of Missouri’s state government. The Governor of Missouri says openly that Barack Obama conspired to misuse his state’s law enforcement resources to “threaten and intimidate his critics.”

We cannot overemphasize the gravity of Governor Blunt’s accusation. While we are not attorneys and cannot give legal advice, “Conspiracy against rights” is a felony under the U.S. Code, Title 18 (Crimes). At present, Governor Blunt’s allegation is exactly that, and Barack Obama, like everybody else, is innocent until proven guilty in a court of law. On the other hand, the court of public opinion is entitled to render a verdict before Election Day, and the following accusation needs to be either disproven or confirmed to the public’s satisfaction. We therefore encourage our readers to circulate Governor Blunt’s press release, which appears below, as widely as possible.

Gov. Blunt Statement on Obama Campaign’s Abusive Use of Missouri Law Enforcement

JEFFERSON CITY - Gov. Matt Blunt today issued the following statement on news reports that have exposed plans by U.S. Senator Barack Obama to use Missouri law enforcement to threaten and intimidate his critics.

“St. Louis County Circuit Attorney Bob McCulloch, St. Louis City Circuit Attorney Jennifer Joyce, Jefferson County Sheriff Glenn Boyer, and Obama and the leader of his Missouri campaign Senator Claire McCaskill have attached the stench of police state tactics to the Obama-Biden campaign.

“What Senator Obama and his helpers are doing is scandalous beyond words, the party that claims to be the party of Thomas Jefferson is abusing the justice system and offices of public trust to silence political criticism with threats of prosecution and criminal punishment.

“This abuse of the law for intimidation insults the most sacred principles and ideals of Jefferson. I can think of nothing more offensive to Jefferson’s thinking than using the power of the state to deprive Americans of their civil rights. The only conceivable purpose of Messrs. McCulloch, Obama and the others is to frighten people away from expressing themselves, to chill free and open debate, to suppress support and donations to conservative organizations targeted by this anti-civil rights, to strangle criticism of Mr. Obama, to suppress ads about his support of higher taxes, and to choke out criticism on television, radio, the Internet, blogs, e-mail and daily conversation about the election.

“Barack Obama needs to grow up. Leftist blogs and others in the press constantly say false things about me and my family. Usually, we ignore false and scurrilous accusations because the purveyors have no credibility. When necessary, we refute them. Enlisting Missouri law enforcement to intimidate people and kill free debate is reminiscent of the Sedition Acts - not a free society.”

If this allegation is true, Barack Obama needs to do more than grow up. Governor Blunt said explicitly that “I can think of nothing more offensive to Jefferson’s thinking than using the power of the state to deprive Americans of their civil rights.” The U.S. Code (Title 18, Crimes) has a specific name for this.

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or

If two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured—

They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.

The “going in disguise on the highway” part probably refers to two or more night riders in sheets and hoods threatening Black people–the same constituency whom the Anointed One claims to represent–with repercussions for voting, exercising their right to free speech, and so on. In fact, a related section of the U.S. Code is known as the Ku Klux Klan Act for this exact reason.

(3) Depriving persons of rights or privileges
If two or more persons in any State or Territory conspire or go in disguise on the highway or on the premises of another, for the purpose of depriving, either directly or indirectly, any person or class of persons of the equal protection of the laws, or of equal privileges and immunities under the laws; or for the purpose of preventing or hindering the constituted authorities of any State or Territory from giving or securing to all persons within such State or Territory the equal protection of the laws; or if two or more persons conspire to prevent by force, intimidation, or threat, any citizen who is lawfully entitled to vote, from giving his support or advocacy in a legal manner, toward or in favor of the election of any lawfully qualified person as an elector for President or Vice President, or as a Member of Congress of the United States; or to injure any citizen in person or property on account of such support or advocacy; in any case of conspiracy set forth in this section, if one or more persons engaged therein do, or cause to be done, any act in furtherance of the object of such conspiracy, whereby another is injured in his person or property, or deprived of having and exercising any right or privilege of a citizen of the United States, the party so injured or deprived may have an action for the recovery of damages occasioned by such injury or deprivation, against any one or more of the conspirators.

Governor Blunt’s press release uses the specific words “using the power of the state to deprive Americans of their civil rights,” “intimidation,” and “silence political criticism with threats of prosecution and criminal punishment.” We would like any attorneys who read this to weigh in on whether, assuming that Governor Blunt’s allegations are proven, this constitutes a violation of the U.S. Code as shown above.

Meanwhile, if these allegations are indeed true, then Barack Obama can be compared legitimately to Adolf Hitler. Godwin’s Law applies only when a comparison of a political opponent to Hitler or Nazis is a gross exaggeration, and “using the power of the state to deprive Americans of their civil rights” is exactly what Hitler and real Nazis once did to Germans.

    Perhaps McCain should bring this up….
    Also, how about arresting and charging everyone involved in this violation of civil rights! Now Missouri has city officials campaigning and possibly arresting anyone who “tells the truth” about Obama.
    Perhaps we need a phone calling campaign to these officials!

    I live just across the river from St Louis in Illinois, about 15 miles from downtown. I can tell you that St Louis is a hotbed of union, radical left democratists. They are rabid anti-Repub. While this distresses me greatly, it doesn’t suprise me.

    I may be wrong, but is it not the law in Missouri that any public employee using his or her office to promote a political candidate is subject to dismissal and other disciplinary actions? Furthermore, is it not customary for public employees to avoid political campaigning entirely so as to prevent any appearance of conflict of interest?

    There is no evidence that this story is factual. It has not been in the KC Star or any major news site. Searching the web only finds the story on a few small websites.

    It appears to be a smear by Republican Matt Blunt. He is not running for reelection because he is very unpopular and has been involved in scandals, such as destroying emails.

    There is a statement of on Blunt’s website, but it provides no evidence to support the smear. Blunt said he has “exposed plans.” He does not site any incident of actual treats to anyone.

    Blunt accused several people that are far too smart to do anything that stupid, such as Senator Claire McCaskill. She was Missouri’s State Auditor and a prosecuting attorney.

Claire McCaskill would lead a group of Democratic lawmakers, prosecutors and one sheriff “who will be proactive in letting voters in the Show-Me State know the truth in the face of the distortions by the McCain campaign,” according to a news release.

    The group includes prosecutors from St. Louis, Dunklin, Lafayette, Cass, Clay, Ripley, Audrain and Jackson counties volunteering to be surrogates for Obama on their own time.”

    Another reason for Blunts attacks. Obama has been gradually winning support in Missouri

    MISSOURI: A new Research 2000 poll has Obama cutting McCain’s lead in the Show Me State to one point, 46%-45% for a poll of “likely” voters. McCain has always done better with “likely” voters as opposed to “registered voters. Likely voters are usually considerably older than registered voters.

    McCain was about 8-9 points ahead. Then 5 points, now Obama is a treat.

    MO’s attorney general is a dem so doubt this will get much traction. maybe the gov will call for some federal if the state AG wont do anything.

    and godwin’s law has nothing to do w/ blog posts, its about the probability of nazis being mentioned the longer a message thread gets. it cant be “violated” and if someone mentions the nazis it proves the law. oh, and proving the law doesnt mean that person “loses” the argument either. it gets misused and misquoted continually.

    The statement is ignorant, to say the least, such are the traditional tactics of the party of Jefferson.

    Today’s scenario is a nearly identical replay of Jefferson’s and his supporters’ libel case against the Federalist journalist Harry Croswell, in 1803-04.

    jjv - I am a conservative with no inclination to make moral equivalencies.

    My point is that far from contradicting the spirit of Jefferson, the party of Jefferson is devising new tactics in one of their oldest campaigns: that of silencing the opposition.

    The Croswell case has another contemporary parallel iwith legal developments in Canada, which the Obama goon squads may be studying. As with Croswell’s accusers (and explaining his first conviction that got Hamilton’s attention), no one questioned the truth of Croswell’s claims, nor was the jury to consider whether the actual statements of Croswell were factual or not. The jury’s decision was to be limited to the question of whether Croswell had penned the otherwise factual words.

    In Canada today the uppermost criterion for publishers to consider is whether any piece of journalism will offend anyone’s sensibilities or not, and not whether the commentary is factual.

    Try a little civility next time and you may be able to detect larger patterns and read between the lines.

    One other thing. Obama can say he won’t raise my taxes out of one side of his mouth but out the other he wants a lot of programs he needs to pay for. Ergo, I think he is going to raise them regardless of what he says. I have a right to say that. If these fascists want to take me to court for saying that, then I hope the people sue them all if Obama wins and raises taxes. They ought to forfeit all their property to help us pay the new taxes they said we could not talk about before the election.
