Update: Obama votes yes and Clinton votes no! Final tally is 69 Ayes, 28 Nays! FISA passes!

Unless Obama does a last minute flip-flop (again), he is set to break the hearts of his far left support base:

The Senate is finally expected to wrap up the bill updating the Foreign Intelligence Surveillance Act today, which includes the controversial provision of retroactive immunity for telecom companies facing lawsuit. While the bill splits Democrats, it’s expected to pass with united Republican support.

Obama will be back for today’s vote and has said he’ll support final passage.

The voting starts approximately 11:15 am ET, and everything on FISA should be wrapped up by 12:30 pm ET or so.

In Obamaworld, apparently wrecking the Fourth Amendment is roughly equivalent to ridiculing some obscure rapper. The only thing more depressing than the conceit that supporting unconstitutional measures is a way to “signal” to swing voters that you are not a radical loon bent on “ideological purity,” which is basically to make defending the Constitution a position held only by radicals and extremists, is the dishonest representation of support for the compromise legislation as being a pro-civil liberties position.

The ACLU are, of course, completely going off the deep end as usual.

can’t count the number of emails I’ve received demanding that I stop criticizing Obama for his support of this bill on the ground that such criticisms harm his chances for winning — as though it’s the fault of those who point out what Obama is doing, rather than Obama himself for completely reversing his position, abandoning his clear, prior commitments, and helping to institutionalize the destruction of the Fourth Amendment and the concealment of Bush crimes.

Ultimately, it’s the sheer glibness of the support for this corrupt and Bush-enabling bill among Obama and his supporters that is most striking.

The Dodd-Feingold amendment to remove telecom immunity from the bill just failed by a vote of 32-66. Obama, along with Hillary voted in favor of the amendment to remove telecom immunity from the bill. A few more amendments to go, and then they’ll vote on the final bill.

December 17, 2007: “Senator Obama unequivocally opposes giving retroactive immunity to telecommunications companies and has cosponsored Senator Dodd’s efforts to remove that provision from the FISA bill. Granting such immunity undermines the constitutional protections Americans trust the Congress to protect. Senator Obama supports a filibuster of this bill, and strongly urges others to do the same. It’s not clear whether he can return for the vote, but under the Senate rules, the side trying to end a filibuster must produce 60 votes to cut off debate. Whether he is present for the vote or not, Senator Obama will not be among those voting to end the filibuster.”

June 25, 2008: “My view on FISA has always been that the issue with phone companies per se is not one that overrides security interests of the American people. I do want accountability, and making sure that, as I’ve said before, that somebody is watching the watchers.”

Update: AJ Strata is liveblogging the votes. The other two amendments fail. One vote to go.

Update via Hot Air: 2:29 pm ET: Obama just voted to approve a procedural motion that will bring HR 6304 up for a vote. Boxer and Durbin voted no on the motion; Obama appears ready to break hearts across the Left.

    After nearly two years of hysterical letter writing, protests, threats, and a whole lot of over-the-top rhetoric, the far-left has once again been delivered a crushing defeat. [...]

    And that, my fellow Americans is the entire right side in a nutshell. It doesn’t matter that the 4th amenement just got scapped. It doesn’t matter that we now have two types of justice: one type for you and I, and one type for campaign contributors. All that matters is that those on the left who want to keep this country ruled by law and not by a single human being have ‘lost’. Always party over country with the right side. No, it is you who has also lost; it will also be your children and grandchildren who would have lost. Maybe you can explain that to them when they ask; please be honest with them. Tell them you were so scared for your very life, you had to scrap 235 years of constitutional government - all to support an illegal administration. Your children will not let you forget your betrayal of our dear values.
