Pro-Life Conservatives Time To Celebrate!

The Associated Press is reporting that the Supreme Court is to take up the Partial Birth Abortion issue.

The Supreme Court said Tuesday it will consider the constitutionality of banning a type of late-term abortion, teeing up a contentious issue for a newly-constituted court already in a state of flux over privacy rights. SOURCE

The decision will now rest in the hands of a newly formed Court. The hotly divided issue, before was 5-4 being broken by now retired Justice O’Connor. Lets hope the brutal practice is outlawed as it should be.

Would this not be a right-wing version of Judicial Activism, or Legislating from the Bench?

Its not the Court’s place to deem if something is legal or illegal. (That is for the Legislature)

The ideal solution would be for the Courts to overturn the bad rulings before that allowed this to happen in the first place and let the laws take their proper course

No it is not a right-wing version of activisim. It is the Supreme Court decideing if the laws that were already passed and struck down in the lower courts are Constitutional or not.

The Supreme Court has been asked to decide if a law is constitutional. This is fitting and proper that they exercise their duty.

But now, we will have to see how the Court relates its judgment to the Constitution and how the public accepts its judgment. I hope they get more cases of importance to decide and that they do so. I am praying for life.

Ah, now that I looked into this more, I feel better.

The Legislature DID write a law. Its being challenged and now the Supreme Court must do its job and interpret it.

Definitely not Judicial Activism.
