9th Circuit Rules Partial-Birth Abortion Ban Unconstitutional

I thought it was Congress job to write laws. Not so says the 9th Circuit! Brutally killing babies by partially removing them from the womb, puncturing their skulls, and sucking their brains out is protected by the Constitution.
The three-judge panel of the 9th U.S. Circuit Court of Appeals became the second federal appeals court in the country to hold the law to be unconstitutional.Source
I’ve said it before, and I say it again…the 9th Circuit needs impeached. Every one of them. Stop legislating from the bench. Uphold the laws, don’t write them.
Federal judges in New York and Nebraska also have ruled the ban unconstitutional. The Nebraska ruling was upheld in July by the 8th U.S. Circuit Court of Appeals, and has been appealed to the U.S. Supreme Court.
Once it gets to the Supreme Court, lets hope the new Conservative makeup slaps it right back down.

As to the first comment, you need to read the opinion. It’s not about saving lives of mothers. It’s about the words “health exception” meaning, to the judges, that it violates the Constitution to regulate between a choice of methods to terminate the unborn.
If a mother’s life was in danger the abortion should have been done before the child was full term. There is no reason to kill a child that is full term and as far as killing a child should not be done after conception except to save the mother’s life or in the case of rape. Any other reason is murder regardless how liberals spin the truth. Where is my haldol is must another moonbat.
Don’t get me wrong, I’m not a lib, and I know the 9th Circuit is looney. But they had no choice in the matter because of the way the Supremes wrote Planned Parenthood v. Casey.
As long as some numbskull who’s been refused medical licensure in all states but one will testify that partial birth abortion is “sometimes” done to protect the health of the mother, the statute as written is in conflict with Planned Parenthood v. Casey.
It’s the Planned Parenthood decision that needs to be revisited, in light of the new federal legislation. Only the Supremes can do that, and do it they will later this spring.

We have a new SCOTUS. Maybe they can finally make sense out of all of this nonsense in re partial birth abortions.
Yes, lets hope the new Supreme Court gets a “good case” where they can really decide on the core issues of abortion. I can’t put myself in a woman’s place vis a vis having a baby. But, my God, if you ever get a reliable eye witness account or see pictures of a partial birth abortion, it will break your heart. I wish I could get those memories out of my mind.
