ACLU Announces Opposition to Alito Nomination

Posted on January 10, 2006

The ACLU’s vote is in! For the first time since Robert Bork, the ACLU are officially opposing a nominee for the Supreme Court. I couldn’t expect any less of the organization. The ACLU vote came after a special meeting of its 83-member national board this weekend, which has voted to oppose only two nominees in its 86-year history: Justice William Rehnquist, and Robert Bork.

Here is an excerpt of their official announcement:

NEW YORK — The American Civil Liberties Union announced today that it will oppose the nomination of Judge Samuel A. Alito, Jr. to replace Justice Sandra Day O’Connor on the United States Supreme Court.

“At a time when our president has claimed unprecedented authority to spy on Americans and jail terrorism suspects indefinitely, America needs a Supreme Court justice who will uphold our precious civil liberties,” said ACLU Executive Director Anthony D. Romero. “Unfortunately, Judge Alito’s record shows a willingness to support government actions that abridge individual freedoms.”

Throughout his career, Judge Alito has promoted an expansive view of executive authority and a limited view of the judicial role in curbing abuses of that authority. Two years ago, Justice O’Connor eloquently expressed what is at stake in these critical times when she wrote: “A state of war is not a blank check for the president when it comes to the rights of the nation’s citizens.”

Romero also noted that Judge Alito has written a series of troubling decisions on race, religion, and reproductive rights while sitting on the federal appeals court. These are precisely the issues in which Justice O’Connor often cast a critical swing vote on a closely divided Supreme Court.

In December the ACLU sent a 68 page report of Judge Alito’s records, along with their letter of “deep concern” to to Senate Judiciary Committee Chairman Arlen Specter and Ranking Member Patrick Leahy. From the recent questioning we have heard from various democrats, it wouldn’t be a bad guess that this is where they got many of their talking points.

“Judge Alito has all too often taken a hostile position toward our fundamental civil liberties and civil rights,” said Caroline Fredrickson, Director of the ACLU Washington Legislative Office. “The Supreme Court is the final guardian of our liberties, and Judge Alito has shown that he lacks the dedication to that commitment. Recent revelations about White House-sanctioned domestic spying, in defiance of the law, make it clear that the Senate cannot, and must not, approve this nominee.”

Translation: The ACLU are deeply concerned that if Judge Alito is confirmed, much of their efforts to force a radical agenda on America through judicial activism might be slowed down dramatically. They have already declared that Bush has broken the law, when their is no evidence to back them up. They are concerned that this Judge just might rule in favor of fighting terrorism, homeland security measures, and the governments efforts to protect Americans. They especially don’t like his answers to questions pertaining to the NSA. Perhaps they fear he will take a strong stand against pedophiles.

If the ACLU is against this man, you know he is the right person for the job. Apparently, the democrats are not doing a good enough job in their attempts to paint him as an extremist. So, in step the propaganda kings. Others are trying hard, using selective quotes, etc., but they can’t compare to the artful skill of propaganda the ACLU does.

They are urging their members to contact their Congressmen to oppose Alito. We urge you to contact them, and tell them to support him. We need a judge desperately in the Supreme Court that will follow the rule of law, and not legislate from the bench, or give in to the radical judicial activism of the ACLU.

CONTACT YOUR CONGRESSMEN TO SUPPORT THE CONFIRMATION OF ALITO
The ACLU are clearly playing politics.

    I’m shocked!

Wow! What took them so long? Get outta here! I just can’t believe it! The guy has all the right enemies. Another reason to support Alito. Good. It would have been disconcerting had the ACLU not opposed him. That means, he should be confirmed without a doubt! I want to know the name of any sane person who thought they were going to support him. There was really no way they could support him, they fear he will take a strong stand against pedophiles.

    ACLU: Anti-Christ Lawyer’s Union.

But, if he were to appear in a public place wearing a KKK hood, and holding a copy of ‘Heather Has Two Mommies’ while setting fire to a Christmas tree, they would be there with bells on to support him.

Actually, when the head of the ACLU says: “America needs a Supreme Court justice who will uphold our precious civil liberties.”

    What he REALLY means is:

“The ACLU wants a Supreme Court justice who will uphold the precious civil liberties of battlefield enemy combatants, al Qaeda murderers, and international Islamic terrorists.”

BTW - Doesn’t this violate their tax-exempt status? Just a thought.

“The Supreme Court is the final guardian of our liberties, ….”
Funny, I always thought that role was filled by me, shotguns and my German Shepherds.

    I guess that’s just a hyperlocal notion.

    The suspense is over.

Good grief! Is anyone truly surprised at the ACLU’s opposition?
