Today, the ACLJ has again represented you and your interests by filing our major brief with the U.S. Court of Appeals for the Seventh Circuit.
Here’s the crux of the situation:
With the help of the ACLU, Mr. Eugene Winkler and other taxpayers brought a lawsuit against the military for their support of the National Scout Jamboree, held every four years.
(It is important to note that the military has provided service and support for this national event since 1937. Furthermore, Congress passed the Jamboree statute in 1972 to formally recognize the military’s role in the Jamboree.)
The plaintiffs argued that the Jamboree statute - and others - were laws ‘’respecting an establishment of religion’’ in violation of the First Amendment …
… since the Boy Scouts’ oath contains an affirmation to God.
The District Court agreed.
As this case makes its way to the appeals court, the ACLJ is ready to continue fighting for religious freedom in America!
Bearing the signatures of 88 members of the House and Senate, our brief contends that - among other things - the Jamboree statute was written by Congress to help the military pursue its own recruiting and public relations interests through involvement with private organizations …
… not to promote the Boy Scouts of America’s religious beliefs.
This is just another blatant attempt by the ACLU and others to destroy the Boy Scouts of America - because it is part of the scouts’ oath to affirm their belief in God.
The Boy Scouts Jamboree is a time-honored national tradition … we cannot allow it to be destroyed to advance the liberal cause of the ACLU and others!
The ACLJ will continue to fight this unconstitutional ruling and will keep you updated on our progress in the days to come.
In three days, The Boy Scouts will have their
National Jamboree. Today Sen. Bill Frist introduced an amendment to the Defense Authorization Bill called, “The Support Our Scouts Act of 2005″.

Earlier this month, an appeals court judge declared Pentagon support for the Boy Scouts of America major gathering — the National Scout Jamboree — unconstitutional.
Why?
Well, in the words of the American Civil Liberties Union (ACLU) — who petitioned the court: the Scouts require members to “privately exercise their religious faith as directed by their families and religious advisors.” That, they argued, was a violation of the Establishment Clause of the First Amendment (separation of church and state). Sadly, the court agreed.
You’re probably wondering what takes place at the National Scout Jamboree … just what it is that had the ACLU so aghast. An American tradition, the National Scout Jamboree is a gathering of over 40,000 people — scouts, moms and dads — at Ft. A.P. Hill in Virginia (a military base). They come together every four years and learn important skills, such as canoeing, leathercraft, land navigation, first aid, and survival skills. They also come together to celebrate their bedrock values. They talk about patriotism; they talk about public service; they talk about conservation; they talk about civic virtue; and they talk about faith. No specific denomination, mind you, but rather the mere acknowledgment of a higher power.
That was enough to set the ACLU attack machine in motion; they put this venerable organization in their crosshairs. Once again, the ACLU sued the Boy Scouts of America.
This is an organization — the Boy Scouts of America — whose motto reads (in part): “On my honor I will do my best to do my duty to God and my country …” They gather — as I once did, as my three sons did, as more than 40 members of the United States Senate and 150 members of the House of Representatives did — to talk about principles. Principles like honesty, integrity, and character. My friends, the Boy Scouts of America produce good kids … the true leaders of tomorrow. They’ve been doing it proudly since 1910. And it’s a sad day when we need to enact legislation to enable them to keep doing it … particularly at a time when we face such unprecedented challenges at home and abroad.
As they say, America’s greatness is determined by our goodness. Well, let me tell you, these kids are as good as it gets. They make us proud. And we need to stand up for them.

I just don’t understand the ACLU’s jihad against the boy scouts strictly because they say a short prayer. It is just plain old prejudice to me.
Great post and I’ve signed as well. However, I think its also important to take this opportunity to point out to the senator that the ACLU is not good for this country and ask why nothing has been done to eliminate them. I wrote to the senator and said the following. We all should start making some noise….
“Dear Senator. I read today with great interest your piece on legislation you have introduced to support the Boy Scouts. I thank you for this effort. In reading your writing on the matter, you mention several times the actions of the ACLU that caused you to have to take this action, and one thought came to mind. The ACLU was founded by communists back in the 1920’s. To date they have succeeded in gaining horrible unfair decisions from the courts that violate the rights of more people than they claim to protect. They make a mockery of our constitution every day, and undermine the very fabric of democracy and liberty our founding fathers carefully put into place years ago. It begs the question, what are our leaders in the house and senate doing to put a stop to entities such as the ACLU, and hopefully put them out of business? This would be a great thing for this country and its people. Can you and your fellow government officials do something about this cancer called the ACLU? Thank you for your time and consideration on this very important issue. “
Jay,The petition has been signed. For some reason I thought of an old friend that has passed away while I was reading your post.He was a member of A.A.,and an old Scout, he had the 12 steps on the wall of his home. I wonder how the ACLU feels about step 3, “Made a decision to turn our will and our lives over to the care of God as we understood him.” Do you suppose A.A. could end up being sued for posting that on the walls of their meeting halls, a public place? I would hope not, I was just having a sick thought.

That is aweful. If the ACLU wants to stick their nose into to something, then do it without interfering with our way of life. I know, impossible! Hey Jay, I have a suggestion about an article. There is news that, we may adopt the chinese way of population control. A fellow blogger, Ken, has the news article at his blog. Could you take a look and maybe do some research and see is the ACLU is invloved? It appears to me that because the national president of the ACLU is a lesbian, she is pissed that the courts ruled that the boy scouts could bar queer scout leaders and are using the myth that there is a seperation of church and state in the constitution to get back at the boy scouts.
I was a Scout for many years and I too credit it for the man I am today. It was a very positive influence and taught me about hard work and decency. Which I think is why the ACLU really has a problem with them. But really how you can expect the ACLU to agree with the BSA when they’re teaching young men to be

And the scout oath I’m sure they find especially offensive when it says in the final line, “To keep myself physically strong, mentally awake and morally straight.”
Why do you people hate America so much that you’d speak out against civil liberties, and would deliberately lie to do so? The court didn’t “find the Jamboree unconstitutional” as you erroneously claim. It found government funding of the jamboree unconstitutional. If you were half as conservative as you claim to be, you wouldn’t want your tax dollars going to that either. Let the people attending the Jamboree pay for the Jamboree.
