Obama Justice Department Colluded with ACLU to Attack Arizona’s SB 1070 According to Documents Uncovered by Judicial Watch
Washington, DC — January 27, 2011
Judicial Watch, the public interest group that investigates and prosecutes government corruption, today announced that it has received documents from the Department of Justice (DOJ) that show DOJ worked hand-in-hand with the American Civil Liberties Union (ACLU) in mounting their respective legal challenges to SB 1070, Arizona’s get-tough illegal immigration law. The documents, obtained by Judicial Watch pursuant to a Freedom of Information Act (FOIA) request filed on June 17, 2010, include email exchanges between DOJ officials and ACLU staff.

“It is one thing to share the ACLU’s disrespect for the rule of law but it is quite another to collude with the organization on a prosecutorial strategy against the State of Arizona. Frankly, these new documents show it is hard to tell where the ACLU ends and the Justice Department begins,” said Judicial Watch President Tom Fitton. “The Obama Justice Department is supposed to be an independent, nonpartisan law enforcement agency. Many Americans will be disturbed, though maybe not surprised, to find that Eric Holder’s Justice Department is colluding with one of the most leftist organizations in the nation. We know whose ‘side’ this Justice Department is on when it comes to the enforcement of our immigration laws.”

No surprise here. After Holder dropped charges against the New Black Panthers I was convinced that racism was, once again, alive and well in America. Only in reverse!
The A?CLU needs to be un-funded by the taxpayers. When they went after the Boy Scouts they lost whatever use they had, which was not much. I am all in! Thanks, Dave.
Eric Holder showed his true colors first when He said his top priority was removing the guns from American citizens hands, then he arrested 2 border patrol agents for doing their job, he gave the drug dealer they were trying to apprehend, carte blanche to go back across the border until the trial, (he was caught again with 800lbs of pot in another smuggling attempt.
Eric Holder is whats wrong with America, this guy needs to be tried for treason, and hung publicly.
When I think of the ACLU, I am reminded of the movie “Walking Tall”. In this flick, the residents of a small town storm the criminals headquarters and burn it to the ground. The ACLU’s activities are in direct conflict with public good and they are generally on the wrong side of every issue. In the past several years, they have gone into “hiding”. In Phoenix, there physical address has been deleted from the phone book, although most people know they conduct their low-life activities from a tall building downtown. The people of America have the power to rid the country of this boil on its butt. This collection of fanatical left wing lawyers should be targeted for extinction – yesterday.
Ed Harris, – You are confusing Holder with former AG Alberto Gonzales who prosecuted BP agents Ramos and Compean.
@IL Minuteman – the ACLU gets no taxpayer funding, at least not as an allocation. All of their funding is private or legal fees awarded by “substantially prevailing” as the plaintiff.
As for collusion, it should be grounds for dismissing the case.
Outside the fact of who attacked the law, the law itself was flawed. If you read it, you would see the areas in which the authors attempted to be cute. I spent twenty years on the street involved in the daily application of law, some involving illegals and ICE. I’m here to tell you the AZ law was screwed up at a number of levels.
The most obvious was the overwritten attempt by the state lawyers to avoid criticism of their language which left no room for practical application by law enfor. on the street. You could almost see the lawyers in the state house giggling and saying, “Well if they screw this up, we can blame the cops for not understanding the intent!”
Second, and more telling about the real issues and who is protected in AZ was the clear lack of serious repercussions to business which knowingly employ illegals. Compare that to the Oklahoma law, passed in 2007, and you could see that state house Billy Bub wasn’t about to get his buddy, Jimmy Joe the business owner, in trouble for using illegals for work.
Here’s the point- you have to ask yourself WHY are they here and then attacks THOSE elements that attract them. Jobs, free stuff, safer environment. So make it illegal FOR THE EMPLOYER to employ the illegal and you would see what was witnessed in OK.- a mass migration OUT of that state to “more friendly” states…like AZ. No American employer would be willing to be fined or jailed for employing an illegal. Then refuse to admit illegals into food stamps, housing, medical care (other than emergency care for injuries), federal programs, state programs, education, etc. You are illegal you get nothing free from us- period.
That leaves fleeing a country that is in chaos, a powerful incentive. However, if you flee there and find nothing here but starvation and isolation, you’ll go back.
Maybe then the Mexicans will stand and fight for THEIR country and not try to immigrate to and then seize ours.
But NOOOOO…. AZ had to be cute about it and wrote one hell of a bad law. When I read it, and then asked the questions about the obvious flaws, people laughed, but then over the weeks and months the EXACT problems I noted were highlighted by others.
It was easy. Been there, done that. Just because the newest pinheaded lawyer in AZ thinks he’s cuter than the last don’t make it so.
