ACLU Upset Obama Isn’t Going to Release Terrorists to Yemen

After a radical Islamist tries to blow up one of our planes with a crotch bomb we find out two of his conspirators were prisoners we released from Gitmo. Obama says he is gonna move Gitmo detainees to America and put them in the American court system, and we are already seeing the disasterous results.

In a ruling this week, U.S. District Judge Thomas Hogan also said the government failed to establish that 23 statements the detainee made to interrogators at Guantanamo Bay were untainted by the earlier coerced statements made while he was held under harsh conditions in Afghanistan.

However, the judge said statements he made during two military administrative hearings at the U.S. detention center in Cuba, where he was assisted by a personal representative, were reliable and sufficient to justify holding the detainee…

The logical inference from the record, said the judge, is that interrogators at Guantanamo Bay reviewed Al Madhwani’s coerced confessions with him and asked him to make identical confessions…

Despite Hogan’s concerns about the 23 statements, the judge relied on other evidence and three statements Al Madhwani made to a military tribunal and a review board to conclude that he trained, traveled and associated with members of al-Qaida, including high-level operatives. On those grounds, the judge ruled he is legally detained.

So the case gets tossed because the judge ruled this terrorist’s confession was coerced.

Military tribunals were created to square this circle, and to ensure basic fairness and reliability while still recognizing the difference between illegal combatants and run of the mill criminals (and also to keep US civilian courts untainted, to keep them from having to bless extraordinary measures as perfectly Constitutional as regards regular criminal citizens), but of course the left and their champion Obama has rejected them as insufficiently prissy and pristine.

Despite all of the evidence the ACLU clings to its stupidity:

“While we appreciate that President Obama stated that he is still determined to close Guantánamo, the decision to halt all transfers of detainees to Yemen will prolong a shameful chapter in American history without making Americans any safer. Continuing to detain individuals who have been cleared for release simply because they come from a certain country is unwise, unjust and does absolutely nothing to improve our security.”

The country has proven to be a volatile breeding ground for terrorists, yet the ACLU still want to release potential killers into the environment. Besides this they have the gall to state not releasing them is unwise and does nothing to make us safer? Who’s side is this organization on? Don’t answer that, it was completely rhetorical.

“After eight years, the continued detention of prisoners without charge is an affront to the Constitution. Today’s court opinion is a setback to justice and the rule of law. The unnecessary endorsement of excessive military detention power and the suggestion that America is free to defy international law flouts all precedent and, if actually adopted, would jeopardize America’s security as well as its values.”

What is a shame is that we still actually allow this enemy organization to function and undermine American security every chance they get. Common sense still evades this ideologically dangerous organization. America does have sovereignty outside of international law especially when it comes to our security, and constitutional rights do not extend to prisoners of war. The ACLU continues to be the best friend of our enemies.
