Buy What Democrats Say to Buy or GO TO JAIL
-By Warner Todd Huston
It has come to this, America. Democrats have decided that if you don’t agree with their policies, you are to be fined. And if you don’t pay the fine, you are a criminal and will be sentenced to jail. That’s right, Democrats are criminalizing dissent.
Speaker of the House Nancy Pelosi has decided to leave language in her heatlhcare bill that criminalizes and prescribes jail time for any American that does not want to buy private healthcare insurance. Think of this, America. I am telling you that the U.S. Congress has decided to force you to buy the product of a privately owned corporation! The power of the U.S. federal government has never been used to purchase something from a private company but here comes San Fran Nancy to do just that. But, let’s face it. She is only taking her cue from the big guy and his “Chicago way” sort of political thuggery.
The Joint Committee on Taxation issued a letter (Download pdf file) in reply to Representative Dave Crump’s inquiry about the matter of the criminal penalties of refusing to buy healthcare insurance should Pelosi’s version of Obamacare pass.
In reply the JCT outlines the exact language in the bill that proves that Pelosi and her Democrat leaders want to turn YOU into a federal criminal if you don’t want to buy her health insurance. Criminal penalties include:
- Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.
- Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.”
Is it Constitutional? Apparently they just don’t care.
But what does it matter if the Constitution is violated by members of the Democrat Party? After all, they will rewrite the Constitution to suit their transitory criteria with which they’ll pass whatever bill they want to push. The Constitution serves as no obstacle at all to their ambitions.
Here is a prime example. CNSNews asked Senator Burris if he saw this power to coerce the people to engage in preferred commerce in the Constitution:
CNSNews: Federally, if you look at it from a federal standpoint, what area specifically of the Constitution would give Congress the power to mandate an individual to have health insurance?”
Burris: Well, that’s under certainly the laws of the–protect the health, welfare of the country. That’s under the Constitution. We’re not even dealing with any constitutionality here. Should we move in that direction? What does the Constitution say? To provide for the health, welfare and the defense of the country.
So, Burris has decided that “health” is in the Constitution? Certainly the words “general welfare” appear there, but health does not. But, pffft. What do these “words” mean? Why should we let laws and tradition stand in the way of getting votes for a welfare program. With glittering jewels of ignorance like accidental Senator Burris crafting America’s policies, it is no wonder we are fast losing our nation to enemies of democracy, freedom, liberty and the American way.

My Congressman is voting FOR this bill.
His spokesperson says there has been a “miscommunication” – another way of saying don’t believe what you hear, trying to say this isn’t in there – but could NOT DENY that that section IS in the bill that my craven Congressman, Mike Thompson (D-CA) will vote for ANYWAY.
He was going to vote for it in the VERY BEGINNING, when they were pushing to vote it through before the Recess, before the Tea Parties, before anyone could read it, before there could be any debate – he was going to vote for it without knowing what was in it.
Find out where yours stands – and CALL THEM TODAY ANYWAY – even if they are supporting it – they will say they got XYZ# of calls in favor, make sure they have MORE against. EMAIL them, that way there is also a record.
Then, when they vote for it anyway, dedicate yourself to helping replace them next election.
Anyone who will vote for a bill they haven’t read has to be removed from office.
CALL and EMAIL NOW.
Hey Blue Dogs… are you seriously willing to end your political career for Nancy Pelosi?
WHY?
What’s in it for you… and your constituents? Hard to imagine why anyone would allow themselves to be hectored into taking-one-for-the-team and incurring the wrath of the nation… when this arrogant socialist twit wouldn’t spit on you if your hair was on fire.
NOW is the time to KILL this pig- there’s no future in backing Obama’s radical plans anymore.
Vote for this highly unpopular bill at your peril… as SanFranNan will leave you twisting-in-the-wind next fall, of THAT you can be sure.
Do you fact check? There are no such provisions in the house health care bill. You are quoting penalties from the IRS tax code for failure to pay taxes.
http://www.slate.com/discuss/forums/3406552/ShowThread.aspx
Yes, the IRS. And that is how they will enforce what is in the bill!
Ridiculous, Warner. First of all, there is a lenient hardship exemption in the bill to exempt yourself from the insurance mandate. Secondly, a modest fine of perhaps $50 may or may not be collected by the IRS, but the point is moot. To quote the maximum penalties for failure to pay your owed taxes as the “penalty” for failure to insure yourself is simply disingenuous.
A “modest fine”? It is tyranny and NOTHING more. $1 would have been no better than $1 million. This bill is a fascist take over of this country. If the combined bill (with the Senate’s version) finally passes we will no longer be America.
When your argument is deconstructed, you just sound unhinged when you revert to hyperbole.
Facts, are facts. This is NOT American legislation. It is European styled. But, you reveal yourself as one that couldn’t care less about America, its Constitution or traditions with your blase support of this fascist legislation. The fact is there ARE criminal penalties. There ARE fines. There ARE fascist means to force Americans to buy a government approved product. All of that is truly un-American.
Further, your poor assurances that the fines are “modest” is itself disingenuous. It is proof that you have no grasp of history. Every despotic government on earth started its pogroms and despotism with “modest” measures like those you celebrate here.
NONE of this is “hyperbole.” It is all fact. Historical fact. Obama, Pelosi and Reid may have just set us on the road to civil war. Let us hope that a new wave of leaders come to Washington in 2010 that can stop this communist take over before it gets too much farther.
But, I believe that we’ve gone too far already. America once had a fine future. It does no longer if it continues on this path.
But how can I take you seriously when you simply respond with more hyperbole?
You can have whatever opinions and ideology you want. But all I did was call you out on the idea – the topic of this post – that you’re going to jail if you don’t buy insurance.
Sorry man, it’s simply not true.
First of all, you cannot say that it is “simply not true.” That is a flat out lie. You do not know what eventuality may occur. The law is there and it WILL be used. I agree that it won’t likely be used much early on. But, history (even American history) proves that it WILL be used eventually and as time goes on it will be used increasingly.
Only a fool would believe otherwise with the entirety of human history to disabuse one of such foolishness.
But the issue is not whether it will be used. The issue is that the policies exist at all. This fact, the fact that they exist at all, is the issue. It marks the decline and death of America and the emergence of a fascist state.
“First they came for the Jews.” Is that “hyperbole,” to you as well?
Bury your head in the sand all you want. Reality won’t pass you by but will kick you in the rear.
Usually, if something sounds ridiculous and hard to believe it’s because it’s not true. To say that “in the future” we’ll be sending people to jail for failure to purchase insurance – especially when low income people will have expanded access to Medicaid and subsidies to purchase insurance on the individual market, plus a hardship exemption – is not an argument.
Even if your logic made any sense, slippery slope arguments are logical fallacies.
The Slaves were freed in 1865. They led a wondrous life for ever more because, heck, they were free, right? Sure a few southern states passed a law or two that sort of hindered them. But, gosh, there was no slippery slope that led to anything like wide=spread Jim Crow throughout the South… right?
Then there was that nice Hitler fellow who only passed a few laws to keep Jews in check, ya know? Heck, there was no slippery slope that would lead to anything like a “final solution,” eh? Good thing that never happened!
Oh, and those laws that outlawed certain drugs? Why, they didn’t lead to any wider crack down that resulted in any “war on drugs,” of course.
Oh, oh, and those few gun laws that first regulated guns? Remember how they never led to outright banning of them in cities all across America? That slippery slope could NEVER happen, right?
Try living in the real world instead of in that fantasy where your sterile Hahvard Debate club rules apply.
I live in reality, not the world of tortured logic.
Good night.
No, you live in a world where you spend all day whistling past the graveyard and looking at the world through those red colored glasses!
Sleep well.
When the world comes to an end after the enactment of health care reform legislation, I’ll check back in on you and see what kind of chains the overloads gave you to wear.
Hugs and kisses.
They’ll probably make me vote Democrat! LOL.
I’m glad you have a sense of humor! But I wish you didn’t propagate the kind of extreme rhetoric that avoids the hard facts. It just makes politics much more ugly than it needs to be, and much less honest.
But anyway, after we get sent to jail for not buying insurance, illegal immigrants get federal subsidies to purchase insurance, and your grandma is killed because a death panel did her in, I’ll concede. Deal?
LOL, deal. And I’ll concede that I was wrong when Obamacare cures cancer, where all of us will be the ideal weight and will live until we are each no less than 150, in perfect health of course. Oh, and when there’s a unicorn in the garage of the government provided mansion we all get from the beneficent Obammessiah and when we are all in that nirvana he promised us, I’ll publicly say you are the expert political analyst.
The difference between our conditions is that my conditions are based on what the right wing is actually saying, and your’s are ridiculous fantasies.
So yes, it’s still a deal.
