Josh Marshall: I Have No Idea About The Birther Issue Facts, But, I Know I Don’t Like It
Josh Marshall brings Teh Funny, along with his rose colored glasses, to the party with Sorry to State the Obvious, But …
Now, I don’t want to get into all the claptrap about the birth certificate. Because the whole story is just unadulterated, raw nonsense. What I do want to figure out, however, is a question that’s been rattling around my head for something like a year now. I have never seen any serious argument that the child of an American citizen, even if born abroad, isn’t him or herself a natural born American citizen. Yes, it’s now and again been raised as a topic with a wrinkle of ambiguity in the law; but the issue has never been that people actually believe such children aren’t ‘natural born’, only that it’s a phrase that was never expressly defined and there’s never been an opportunity to have a court review it since there’s never been a case with the relevant set of facts.
Yeah, just like that issue involving the phony cBS Texas Air National Guard documents, right, Josh? I mean, you obviously thought the story was just unadulterated, raw, partisan nonsense, right? Oh, wait, guess not. Here’s his last post on the subject
I’m clearly not a forensic expert on document analysis. So I don’t have any way of knowing or even coming up with a reasoned opinion about the authenticity of these documents published by CBS.
But one point of criticism doesn’t seem as clear as many are presenting it. I’m talking about the suggestion that a superscripted “th” marks these as clearly the product of a word-processing program.
So, even though the documents were clearly demonstratively fake, and Josh is no expert, he decided they were real, and posted quite a bit with the position that the docs were real, and Bush had to prove them wrong. But, this wasn’t unadulterated, raw nonsense, you know.
To be clear, I believe Obama is a natural born citizen, and will take that position until someone provides concrete proof. However, considering that the Constitution states that one must be a natural born citizen, why is it so much to ask for Obama to provide that proof?
Just One Minute also jumps in on the birthers vs. twoofers issue, which I sorta covered myself the other day.

I don’t pretend to know whether or not O’s birth certificate is in Hawaii.
However, I can’t understand why he would spend a million dollars in legal fees to keep anybody from seeing.
It doesn’t make any sense at all.
i don’t know if he is or if he isn’t, i think he is obligated to show us the certificate……the millions he is spending are not his, it is our money. mr. transparency spends a lot of our money being opaque. his grandma said she was at his birth in kenya, his sister says he was born in one hawaiian hospital, he said he was born in another. i know where i was born and i have the ’stificate to prove it.

Meanwhile, Dan Riehl says that the Left is pushing this issue. (Apparently as part of an infinite, issue deflection, regression that started with healthcare which was then being deflected by gatesgate which is now being deflected by birthergate which will be deflected by something about Bush, I’m sure.)
(And, for the record, I’d just like the dude to cough up his birth cert so everyone would just shut up already.)
In the ’60s Congress passed a law that stated a person’s Home of Records(where you were born and actually joined the military) could charge a person back taxes on his military pay(they even loved us back then).
My Marine brother-in-law found out how well we were liked when SC sent he and his wife a bill for back taxes! His wife was back taxed for playing the organ in their church while stationed in SC.
I was in the Air Force, stationed in Hawaii at the time. Hawaii said they would never charge military people state taxes. So, one day my squadron had a huge computer print out of every active duty person in that squadron.
Finding your name, and signing it transferred your home of Records to Hawaii.
Basically you were, not really born there, but SORT of born there.
Sound familiar?
I should have clarified my brother-law,my wife and I were born in SC. His wife was from MN.
That was the reason why, when he retired in ‘73, they stayed in CA.
What is the name of the Dr. that delivered BO? What hospital? Clinic? Midwife? The DR.’s name is on all my children’s birth certificates. Why won’t he show us his college records. He’s so proud of his education, but we know nothing about his studies or his grades.
Last month, I went down and signed up for my Social Security “entitlement” and was REQUIRED to show them my originial birth certificate, or be denied. Seems like it wouldn’t be that much trouble for the sitting President of the United States to go to the same trouble.
I resent being called a “birther”
I agree with the other comments. Why did he seal ALL of his records/b.c.? Did he pose as a student from another country for college aid? And if this is a distraction from the real problems…why is he furthering this agenda. Remember Americans pick their issues and this one isn’t going away. We can handle multiple issues…believe it or not.
I don’t know what the courts hold but according to common law which was in force at the time of the U.S. Constitution you are a natural born citizen of the allegiance you are born under.
I would say that since you are born to parents who gave their allegiance to the U.S. and are there dependent then you have an implied loyalty to the U.S. through your loyalty due to your parents. That would make you a citizen of the U.S.
I do know that some go by territory and in general that would be true but what about children born to ambassadors or even a leader of a country while visiting a foreign country.
The thing is, most of the laws are all over the place regarding what is considered to be “natural born,” rather than simply a US citizen. If Obama was born in Hawaii, he is a natural born citizen. If, as some say, he was born in Kenya, he is a US citizen, but, not natural born.
This issue is indicative of how bad our government has become! We have the rules but everyone passes the buck on who should be enforcing them. All the states assumed that someone else validated he is eligible to be president. The Democratic party has no need to prove it since they have the media and so many corrupt special interest groups in their pocket. They clearly don’t believe in the constitution or any other rules in our country – all they seem to care about is being in power (at any cost). Those that just want to know how the rule is enforce are met with blank stares or vehement and angry Obama supporters that can’t believe anyone would dare question him. The precedent has already been set to whitewash the whole isseue since the House of Representative passed a resolution last year to “allow” McCain to be eligible even thought the resolution was unnecessary since he proved his eligibility. The House will clearly do the same for Obama when the uproar gets loud enough. No one will ever ask to see any of Obama’s records from his past and what is amazing is how little the media and supposedly other intelligent liberals don’t see how crazy that is. It would NEVER be allowed for a conservative.
Interesting statement released by Chairman Steele today:
“Chairman Steele believes that this is an unnecessary distraction and believes that the president is a U.S. citizen. Chairman Steele wants to move beyond this conversation and continue discussing the real and immediate concerns that face American families like the economy and health care. Americans are concerned with President Obama’s health care plan, a failed stimulus package and a ballooning deficit. Chairman Steele has many other issues to take up with the president that have to do with policy, not a birth certificate.”

Editor’s note: “Chairman Steele believes that this is an unnecessary distraction and believes that the president is a U.S. citizen. …”
Unfortunately for Mr. Steele, the Constitution doesn’t read; No Person except a natural born Citizen, or [any person believed to be] a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President;…
