Disabled Children Lose Fight Against ACLU
I’ve got good news and bad news tonight regarding the ACLU. I’ll start you off with the bad news and then give you the good news. The bad news is that the ACLU won one, and disabled children lost in the process.
The American Civil Liberties Union won its fight against disabled children Wednesday when the Arizona Supreme Court struck down a state program that allowed special needs kids to use vouchers at private schools so that they could receive the best educational opportunities. ADF attorneys joined attorneys from the law firm of Orrick, Herrington & Sutcliffe last year in submitting a friend-of-the-court brief on behalf of a Christian school in defense of the voucher program, which was upheld by the Arizona Court of Appeals.
“The ACLU, People for the American Way, and the teachers’ unions have denied disabled children the educational opportunities they deserve. They are the ones hurt by this,” said ADF Legal Counsel Jeremy Tedesco. “Special needs students who attend Christian schools shouldn’t be penalized for their beliefs.”
“Any tuition that goes to a religious school is through the choice of the parent and for the benefit of the child. It is not ‘state support’ of that school,” explained Orrick attorney Raymond Mullady, who co-wrote the friend-of-the-court brief. “We truly disagree with the high court’s decision and are saddened by its consequences for Arizona’s special needs children.”
John and Dina Phipps and Brendan and Susan Fay, founders of Father’s Heart Christian School for the disabled, removed their developmentally and physically challenged children from the Arizona public school system because of the inadequate education they received there. Two of the children suffer from autism and the other from learning and physical challenges.
Upon receiving the customized instruction they needed at Father’s Heart, their behavior and participation improved remarkably and their academic performance rose several grade levels in just one year after leaving the government school system. The children receive vouchers through the Arizona Scholarships for Pupils with Disabilities program to attend Father’s Heart, but Wednesday’s decision from the Arizona Supreme Court effectively kills the program.
Cave Creek Unified School District board member Virgel Cain, the ACLU, People for the American Way, a number of teachers’ unions, and others filed suit against Arizona State Superintendant of Public Instruction Tom Horne to challenge the constitutionality of the voucher program.
Meanwhile your tax money is paying to install footbaths for Muslims in a public school somewhere and the ACLU remain silent. Somewhere CAIR is teaching school children about Islam, and the ACLU remains silent. However, they won’t sit idly by and allow autistic children to receive a better education. Absolutely not if it involves attending a Christian school. They should be ashamed, but they are probably quite proud of themselves.

Where’s the good news?
Boo. Hoo. This was a no brainer from the start– public funding of tuition for students to attend religious schools is just not going to happen. If students “need” to be in a religious school, their parents can pay for them to attend. And if the same parents want their children to attend public schools, then they can ask the public schools to make proper accommodation for them.
More stupid ruling this time from the ARIZONA STUPIDREUM COURT and the sinister ATHEISTS.COMMUNISTS and LAWYERS,UNDERGROUND never a more sinister group of vile villians around
this headline is so slanted. the true injustice is to public schools. 82% of Arizona’s kids attend public school and yet GOP legislators want to help private schools instead. this is not a disabled/non disabled issue. it is a constitutional issue of why they insist on helping private schools when the constitution protects public schools, as it should.

Where does the Constitution mention the establishment of public schools? The Constitution doesn’t protect government institutions, it protects the rights of Citizens. At least, it is supposed to.
They aren’t trying to help private schools, you brain-dead, hippie dope fiend. They are trying to help kids with serious handicaps get the education they need. The GOP is doing what you Leftists PRETEND they want; give poor parents the same choices as rich parents. The property tax is confiscated from everyone, Christian, Jew, Hindu, atheist. Between the NEA and the teachers unions, if they can’t manage to cobble together a decent school for some handicapped kids, I don’t see why you quarrel with the parents, who pay taxes, being allowed to use their tax money at a competing school? I guess you would rather see children suffer in the hands of incompetant schools then to allow their parents freedom of choice.
I thought you people were all about choice? My body, my choice, right? If we are supposed to allow you the freedom to destroy the nascent life growing within you, why can you not allow people the freedom to use their own tax money to support a school that conforms to the needs of their children and perhaps their own beliefs?
Brain-dead hippie dope fiends unite! That would have to include, I suppose, the judge who wrote the opinion:
‘The programs are “a well-intentioned effort” but the constitution’s flat prohibition is clear, Justice Michael D. Ryan wrote. “The framers plainly intended that Arizona have a strong public school system to provide mandatory education.”’
The whackos who think the ACLU is some terrible organization strewing havoc don’t seem to understand that the ONLY weapon they bring to bear is THE LAW. They are certainly not all atheists, I doubt many are communists, and only a few are lawyers. I am a member– a Deist, Democrat, anti-communist and have never been found guilty of practicing law.
Laws, and practices, however well-intentioned as we all agree the program in question is, must meet the standards of the Constitution. This law didn’t even meet the standards of the *state* Constitution, never mind the Federal one.
Having a ’strong’ police force in no way implies that private security serves are illegal.
Having a ’strong’ fire department in no way implies that sprinkler systems are illegal.
Having a ’strong’ parks and recreation system has hardly outlawed private gyms, libraries, playgrounds, and the like.
So why the difference?
It is amazing to me how many Plants come on these sites to confuse the issues. They have plenty of their own site, like the entire main stream media to spew. It is so sad that they cannot see that this is about disabled kids getting the education they need which the Goverment has never been able to provide. Who cares if it is a religious school as long as it does the job? Its the parents of these kids tax money paying for this also. I know from whence I speak. I am disabled. There is a growing mood in this country against the disabled. I have heard the rumblings about rationing health care to the disabled. If that happens it would basically kill me. But that is what Hitler did, is it not? He sent SS into hospitals to machine gun the ill and disabled. And our wonderful president then makes jokes on a TV show about Special Olympics. He should be ashamed of himself. Don’t nay say ME. I have had people run into me with baby strollers and say “Get the F*** out of my way, you cripple”, Just last week in Target, a woman ran into me with her cart on purpose and then when I pointed out I was disabled, her husband elbowed me out of the way and said, “who cares?” Someday, you able bodied people (I used to be one of you, I broke my back protecting and serving you) will find out what it is like to be ill or disabled and treated like a second class citizen. I never thought I would say it, but I can’t wait to see you suffer through it. I can take your insults, but this is about children. How cruel and selfish you are. PS. Don’t bother to reply to my posts. I do not respond to anyone who is not polite, civil and intelligent; the rest I IGNORE as I know it makes them crazy with frustration. And politically incorrect as it is, God Bless these children and the people who care for them.

Could it possibly be that you are giving these cretins too much authority over how your day is going to be? I don’t mean to sound disrespectful. I have been there when I allowed people to walk over me due to the fact that I was the one considering myself a second-class citizen because I could no longer contribute to society. When I fixed myself (it takes time and acceptance), no one can ne’er hold a candle to me. (Or however you say that. lol) I will be praying for your soul to heal. Have a blessed day.

I work with the disabled and have a neice that is down sym. I am so sick of the aclu is there anyway we could sue the aclu for the childrens rights and for our religous rights as well. children have rights too and yes if a child is going to use a voucher for a private schools. Maybe the vouchers could pay between 50-75% of the tution? health care is a joke no insurance company government or choose your own is going to cover a prexsiting condition. if your a dem in the government you can get away with anything, if you oppose the health care reform your every name under the sun by the speaker of the house who owes america an I am sorry. If your the pres your wife can fly air force one to demark and the next day your husband flys air force one to demark too remember everytime air force one goes up the other 2 decoys go up. I have a client that flew air force one 3 times carring Regan and the decoys many times. this tax payers mony being spent so that the state of IL can host the 2016 olympic games. I guess the games are more inportant than protecting our troops and the state our country is in.
But every child has a right to the best education that there is and just because they are disabled does not mean they have no brain.
I still say why not america sue the aclu over their stupid causes. now they are after a cross that is on fed land (yes I do understand speration of church and state) that is for vets of ww1, ww2 and all vets. now they have a box over it next thing it will be we can not have crosses on grave stones in fed grave yards, and why did the government let the muslin religon have a hole class room just os they can go and pray during school time and we christens can,t even be seen with a cross or a bible in school. talk about double standards. I have had my say so excuse me I just take my country to heart and when the aclu takes on children they are just a group of sick, sick, sick people that have lost their way.
This one’s a no brainer. If you knew from the inside out what special ed was all about, you really wouldn’t care whether these kids when to Christian, Muslim, or whatever type of school available to meet that particular need. Public schools have a duty to educate these kids and it’s not happening. Parents aren’t trying to buy a “cadillac” education. They just want their kid to learn. You have 3 options: teach them and allow them to grow into productive citizens, let them get into crime, or support them on the government tab for disability. It’s in all of our interest to further their education.
