Jerry Brown Says “Thwart The Will Of Californians”

So, the Democrat mantra is “count every vote! Direct Democracy!” But, doesn’t mean they actually will implement the will of the voters

California Attorney General Jerry Brown changed course on the state’s new same-sex marriage ban Friday and urged the state Supreme Court to void Proposition 8.

In a dramatic reversal, Brown filed a legal brief saying the measure that amended the California Constitution to limit marriage to a man and a woman is itself unconstitutional because it deprives a minority group of a fundamental right. Earlier, Brown had said he would defend the ballot measure against legal challenges from gay marriage supporters.

But Brown said he reached a different conclusion “upon further reflection and a deeper probing into all the aspects of our Constitution.”

“It became evident that the Article 1 provision guaranteeing basic liberty, which includes the right to marry, took precedence over the initiative,” he said in an interview Friday night. “Based on my duty to defend the law and the entire Constitution, I concluded the court should protect the right to marry even in the face of the 52 percent vote.”

Well, holy carp, Batman!, but California’s Declaration of Rights is freaking huge, and I guess “persuing…happiness” can fit in with Jerry’s model, but, like with abortion, nowhere does it say that anyone has the right to a church marriage. My question is, who paid him? Who got to him?

Prop 8 is just an inconvenient example of The People voting and deciding an issue for the Democrats. Now, if the vote had been the other way, they would be crowing about it, and saying “The People have Spoken! It’s over! Moveon, neocons! You lost!” Now we get to see what happens with all the litigation coming from what The People voted to abolish.

A new war of words over gay marriage erupted on Friday as the sponsors of Proposition 8 asked the California Supreme Court to nullify the marriages of the estimated 18,000 same-sex couples who exchanged vows before voters last month approved the ballot initiative that outlawed gay unions.

That should send some folks in to apoplexy.

Just for reference, I could almost really care less about the whole gay marriage issue. If forced to vote, I would vote against gay marriage, but, I do think they should be allowed civil unions. This is America, and, if it doesn’t harm me or someone else, why would I stop someone from doing most things? Yes, there is a line, of course.

    Possibly the Democratic mantra is Court every vote. One of the major problems with the Liberal agenda is that they believe that they are so right that anyone who disagrees is evil. I can only hope that President Obama, who has made some interesting choices, will continue to recognize that only with the passage of more time than a single generation are we able to start to see the light of truth. If you don’t believe that you need a more solid background in the history of the human race.

    If they want a direct democracy and counting every vote, then I guess there’s no need for Representatives and Senators anymore, since that’s, like, a REPUBLICAN democracy and not DIRECT.

    How, exactly, can the state constitution itself be “unconstitional”?

    Yet another aspect of our lives where the government nose has intruded yet does not belong. Just like abortion, seatbelts, and any other number of personal choices that are being legislated to death.

    The state has always had the power re regulate marriage. Which is why is illegal to marry your first cousin, except in Arkansas, and why we banned the Mormon practice of polygamy. If you accept Jerry Brown’s logic, or lack thereof same, as binding, the state, to wit the People, have no power to regulate any thing anybody would care to call marriage.

    Call that what you will. It sure is not civilization.

    You may not care about gay marriage, but it cares about you.

    If you think that letting gays “marry” will have no effect on anyone but them, think again.

    Gay marriage is about a lot of things, but marriage isn’t one of them. It is about trying to radically remake our society in a way to their liking. It is about forcing everyone to equate their lifestyle as equal.

    You doubt me? If gay marriage becomes legal, they’ll demand that all churches marry them or lose their tax exempt status. They’ll demand that all photographers and caterers serve their weddings or face lawsuits. They’ll pass “hate speech” laws effectively outlawing all criticism.

    California allows its book sized constitution to be amended by a simple majority vote of the people, but it takes a 2/3 vote of the legislature to pass a budget and a 2/3 vote of the people to proposition to raise taxes. This is a strange system.

    I think Attorney General Brown’s argument is that Proposition 8 is so radical (by California Standards) that it constitutes a fundamental rewrite of the Constitution which would require a 2/3 vote.
