Student Forced to Remove American Flag T-Shirt

Posted on September 22, 2008

What has our country turned into???? This is absolutley horrifying! Political correctness has killed our First Amendment. If the children had wanted to burn the American flag it would be considered a protected right, however.

Officials at the Merced County school confirmed Thursday that Jake Shelly was forced to take off a red, white and blue tie-dyed American flag T-shirt on Tuesday. The shirt said nothing offensive, just: “United States of America, Washington, D.C.”

The school’s assistant principal issued Shelly a bright yellow T-shirt that read “DCV: Dress Code Violator” to wear for the rest of the day. He was given his shirt back after classes ended.

“It was really embarrassing and humiliating to have to wear that all day — and just for supporting your country,” his sister Kaycee Shelly said.

Kaycee Shelly told members of the media at lunchtime that her brother was overwhelmed and did not want to do any more interviews.

Earlier in the day, he was speaking with a local news station when an unidentified teacher walked up to him, ripped off the microphone clipped to his shirt and told him he was not allowed to talk to the media.

How outrageous is this? They punished the kid by shaming him…and for what? Being patriotic? No civil liberties groups will step in, because after the media swooped in on this they quickly realized how stupid they had been and apologized. But really, the question remains how they could be so stupid. It’s simple, this is where political correctness takes us….further and further away from freedom. This kid should sue. The school only apologized after completely humiliating him, and then only after being exposed by the media. Do the ACLU still take Americans for clients?

I wish they would try this with my son. Humiliation would be handed back in kind, with lawsuits of epic proportions which would cause me to own the entire county he is in. This embedded hatred of America must be put down and destroyed. If this kid had a paleswinian shirt on they would have said nothing.

If he sues, imagine the conundrum if the ACLU defends the kid.

Here’s something similar: My daughter is in the fourth grade at a school in Columbus, Ohio.

At the beginning of the school year, the schools always hand out their “dress code” saying that it’s important that kids not make any statements with their clothes that may “offend” someone.

Over this past summer, I guess a couple of the teachers retired and some new teachers…right out of school from the looks of them. One is a very nice seeming young black male teacher. This to me is awesome! I think kids, especially boys, need positive role models.

Well….Right before the hurricane winds struck here, This teacher wore an Obama T-shirt to school. Before people get upset…I don’t care who this teacher supports, and I could care less what color Obama is, but I think this is disgusting!

I think one of the things that we expect from teachers is that they teach our kids information that isn’t biased…they get enough of that in the world as it is. How can this person teach the children in his class about presidential elections now? What about the kids in his class whose parents don’t support Obama?

One of the other parents went to the principal of the school asking if this was allowed…she was told that since it didn’t “cause trouble” she could not do anything about it.

This parent told me this in confidence because she was afraid that if she spoke up about who she supports, she would be called a racist. Myself, I have already been called a racist.

If I were to send my daughter to school in a Mc Cain T-shirt, I would be willing to bet money that she would be sent home or that I would be called in. I wouldn’t do this to my daughter, of course..I’m not sure she could handle the teasing and racist comments.

I realize this isn’t exactly the same thing as the article above, but it’s something that has really bothered me for the last couple of weeks..I wanted to post something last week, but had no power due to the ineptatude of our electric company.

Does anyone have suggestions as to how to deal with this?? I really think something should be said, but am not terribly sure what. I would LOVE suggestions..

    Thanks,

    Shana

Un-freaking-believable. I say we call this school and request an explanation. “Who exactly did this shirt offend?”

This site does a great job in identifying these types of mis-behaviour. However, it may be time to create an additional site to start placing names/places/pictures of these actions.

Another Liberal running a school that hates America. Why don’t they all just pack there stuff and get the hell out of America if they hate this country so much. They will not leave because they can’t do this kinda stuff any where else in the world and get away with it. Or they could give them their own state and build a wall around it and call it Escape from Liberal Zoo. It would be like a big lab experiment. We would get to watch them turning on each other.

Now we got to keep an eye out on the schools we are sending are kids. Its really sad.

    J,

I’m not sure the school was out of line, here’s why:

    US Code TITLE 4
    CHAPTER 1, § 8.
    Respect for flag

    (d) The flag should never be used as wearing apparel, bedding, or drapery. It should never be festooned, drawn back, nor up, in folds, but always allowed to fall free. Bunting of blue, white, and red, always arranged with the blue above, the white in the middle, and the red below, should be used for covering a speaker’s desk, draping the front of the platform, and for decoration in general.

I am all for patriotism, and there is a time and a place for everything; the yellow shirt was rediculous however, and over the line.

    Thanks, Jay:

I have a further observation (read = wish) that the parents of this kid should sue the school teacher for touching their son, ripping off the microphone while he was talking to the media. In the law, that’s simple battery.

    Gawfer,
Not sure that 4 USC covers this. WOuld have to see the shirt. Regardless, it is not up to the school to enforce this.

I might add that even though I agree with 4 USC it is not a code with penalties as burning a flag violates it (unless properly disposing) and the courts have ruled this legal.

It also states that the flag is considered a living breathing entity.

Be that as it may, this is not a matter for the school to decide. I am willing to bet I can go to the school and find it in violation…

As for the Obama T shirt. Wear a McCain one to parent teacher night. Also, tell the principal that it is a violation of their own dress code…
