ACLU Wins Case for Lesbian Trapped in Man’s Body

Sound like parody? Well, isn’t life a parody?
A federal district court judge in Washington, D.C., ruled today that the Library of Congress discriminated against Diane Schroer when it offered her a job and then rescinded it after learning she was transgendered.
The American Civil Liberties Union, which represented Schroer, said Judge James Robertson’s ruling is the first to hold that the federal sex discrimination statute, Title VII of the 1964 Civil Rights Act, applies to transgendered people.
Other courts that have considered the issue have said Congress only intended for the anti-discrimination statute to protect men and women, but not people who change their sex, the ACLU said.
Robertson disagreed, saying Schroer’s case “was discrimination based on sex.”
“It is tremendously gratifying to have your faith in this country, and what is fundamentally right and fair, be reaffirmed,” Schroer said. “I very much hope that this ruling will help to eliminate the all-too-pervasive discrimination against sexually nonconforming people in all areas.”
She added, “I hope, too, that employers, family members, friends and co-workers will begin to understand variations in sexual orientation and identity from a basis of knowledge and not fear.”
Schroer said she applied for, and was offered, a job at the Library of Congress as David Schroer.
When David went to his first meeting with his soon-to-be boss, Schroer told her that he would be transitioning to a female before starting the job. The next day, the job offer was rescinded, Schroer says.
A particularly interesting portion of the article:
“We had a normal sexual relationship,” Schroer said. “Although, I would say that I would often think of myself being on the other side of the relationship.”
I just ran all out of snark. It’s a good thing Stacey McCain has some to spare.
Just because I’m at a very early stage of transition — being a married father of six and all that — doesn’t mean that I don’t have rights as a transgendered lesbian. So I’m applying to be an op-ed columnist for the New York Times and if they don’t hire me? Hey, see you in court, you sexist homophobes! (I’ll also sue the Pulitzer Prize committee for their years of discrimination against me.)
Once I hear back from my ACLU lawyer, we’ll be on our way to the landmark case of McCain v. Sulzberger, forever enshrining in the Constitution the rights of all of us who are proud to be gay women with penises, just as the Founding Fathers intended.

Wasn’t it Rush Limbaugh who made a wisecrack many years ago about being a “male lesbian”? I bet even he couldn’t imagine that the ACLU could turn that into a legal reality.

As a Lesbian trapped in a mans body I can sympathize with the victim in this case. I went a different route and started L.I.M.B., Lesbians In Men’s Bodies, a support and lobbyist group for those of us who just know we are a lesbian but have the unfortunate circumstance of being born into a mans body.
Now some may ask us how we know we are a lesbian and there are a few distinct and telling signs.
One, we like to keep our hair short.
We like to wear flannel shirts.
We are attracted to and distracted by women.
It is hard enough living as a lesbian in a mans body without simpletons like you making fun of our very serious condition, and as soon as my girlfriend gets back from her spa treatment I am going to march down to the ACLU and we’ll see you guys in court.
I almost wet my pants over that one, Kender.
So…. a lesbian trapped in a man’s body… isn’t a man?
Whether you know it or not, someone you love is GLBT. Whether you know them or not, someone who is GLBT is fighting for rights for which we will all benefit.
How does another’s sexuality change your life? You should concentrate on how you can make the world a better place, not on judging the plight of others.
I notice you have banners on your site promoting drilling for oil too. Do you really believe more drilling will lower fuel prices? Are you that naive? Wouldn’t alternative, renewable resources be better? Oh, that’s right, you are a Republican. You believe big oil should be just that, despite the environmental effects. It’s ok, you’ll be old and die before people have to deal with that. It’s not your problem.
Where is the ACLU at when a baby is trapped in a women’s body about to have an abortion?
You go James….drilling oil that’s safely hidden away under our land will in no way lower fuel prices. I don’t know people are thinking. Why, the very thought of increasing our oil supply to refine more fuel in a misguided attempt to lower prices by increasing supply is not only ludicrous but outright daffy.
Anyone who believes prices can be lowered by increasing the availability of a given commodity is simply listening to those economic simpletons who preach supply and demand.
Idiots all. Everyone knows creating more of a product makes it more expensive.
