Mass Democrat to Child Rape Victims: I Will Destroy You!

Absolutely outrageous and angering!

Democratic Representative James Fagan was in the Massachusetts State House yesterday railing against Jessica’s Law, which would mandate 20-year sentence for rape of a child under 12. As a defense attorney he took offense to the idea that someone convicted or raping a young child should have a mandatory sentence imposed on them, arguing it would force him to attack the little girl in order to defend his client:

“Let me tell you why it’s so wrong, It’s so wrong because in these situations . . . that 6-year-old is going to sit in front of me, or somebody far worse than me and I’m going to rip them apart. I’m going to make sure that the rest of their life is ruined. That when they’re 8 years old they throw up; when they’re 12 years old, they won’t sleep. When they’re 19 years old they’ll have nightmares and they’ll never have a relationship with anybody. And that’s not because I’m a nice guy. That’s because when you’re in court, and you’re defending somebody’s liberty, and you’re facing a mandatory sentence of those draconian proportions, you have to do every single thing you can do on behalf of your client. That is your obligation as a trial lawyer.”

In essence, he argues that the only way to prevent him from “ruining” her life, is by offering leniency to the child rapist in the hopes he does not attack another young girl.

Absolutely! This is the kind of scum politician I’d just have to punch if I ran into them. Sick. There is a special hot spot in Hell for creeps like this.

    Here is a suggestion. How about the way we ensure that kids don’t go through this is to allow the father to have 10 minutes with the pervert?

    I would kill the schmuck from so far away he would never see it coming.

    All I can say to the attorney is that if he did that to my daughter, well let’s just say that is what lime is for.

    We should also provide mature young ladies and their families or escorts with effective concealed weapons, so that the only question provided to society is what kind of burial is provided to the attempted rapist.

    I bet Fagan is simply protecting the turf of his friends in the judiciary. Jessica’s law would take away some of their power.

    It would actually be professionally unethical for a defense attorney not to ask tough questions of the child accusing his client of rape.

    Of course, that’s not what he’s saying. He seems to want to do everything he can to psychologically damage a child out of pure vindictiveness.

    Determining whether sexual contact between adults was consensual or forced is one thing, but with a 6 year-old, consent isn’t an issue.

    If there is physical evidence, the credibility of the child is irrelevant.

    This argument doesn’t even make sense. Wouldn’t he argue against the child just as much whether it means five years in prison or twenty years? If the strength of his argument depends on whether there is a mandatory sentence, then he is not a good attourney in the first place.

    This Lawyer’s view should certainly not be associated with the entire democratic party. While he may identify himself with the Democratic Party, his statements are clearly misguided and his argument faulty. It is a defense attorney’s job to do what ever it takes to defend their client, guilty or not guilty no matter how sick the crime. However, it is everyone’s job, including the defense attorney’s, to protect the innocent and the weak and to not engage in psychological or emotional abuse regardless of the situation. There is always an alternative. This man should be ashamed of his comments.
