Supreme Court Creates Killing

In a 5 to 4 decision, the idiots on the Supreme Court have decided that terrorists are covered by our Constitution, no matter where they are captured and held.

This is as wrong headed a decision as can be imagined and two of the Justices, Scalia and Roberts, were scathing in their dissent.

But, here is the real result of this ruling. No, it doesn’t “help” the murderers and terrorists get habeas corpus, or find rights, it will kill them on the battlefield. What battlefield commander will waste his time trying to figure out what rights the terrorist he is facing has or doesn’t have?

The proper and reasonable decision to make on the battlefield will be to automatically kill EVERY captured person as soon as you do a quick interrogation. After all, anything else will simply just get the commanders on the line in trouble with the “law.”

And, I cannot say I’d blame any American soldier on the battlefield. Just kill every one of those captured without regard for their status. Their innocence? Immaterial. Kill them anyway.

This is what the dolts on the SCOTUS have wrought.

So, here’s hoping that more of these people are merely executed on the field and left for dead instead of brought into custody, introduced to American rights, and then released into OUR country as they await their undeserved day in court. As they are let go HERE in THIS country while those who would assist them to destroy this country pretends to get them their day in court, they then will have access to THIS country where they can wreck their terrorist agenda.

Nice going SCOTUS. Not only will you be responsible for killing more on the battlefield, but you now have also set up the possibility that terrorists will be let go to freely enter our country to commit acts of terror on us while they pretend to be waiting for their court cases to be adjudicated.

In essence, the SCOTUS is now a party to automatic killing of prisoners and, for those not killed, they are a party to opening up this country for more terrorism. And the SCOTUS has materially damaged our ability to fight terrorists.

The law is an ass.

    How do you a Afghan dirt farmer is a terrorist if he’s never had a hearing?

    Taking the government’s word for who a terrorist is and who isn’t, when the government has released almost 200 people from Gitmo without charges or hearings seems to be placing a lot of credibility and power to that government. Seems to me our Founders thought differently about government power.

    My feeling has been that ununiformed combatants should be swiftly interogated and then as there due under the geneva convention executed.

    Guilty until proven innocent, but not afforded any meaningful opportunity to have their cases heard. Excellent, seems perfectly ok to me. Why do these “terrorists” / “enemy combatants” need anyone to look over the Unitary Executive’s shoulder. Only the UE knows what the UE knows and the UE knows all. Just bow to the UE’s authority – no checks, balances, or oversight necessary.

    Not the world i want to live in and luckily not the America the founding father’s envisioned. The law hurts sometimes, but it is the law for a reason. This way you and yours can’t sit as judge, jury and executioner so that all your mistakes can be buried or cremated.

    Actually, there will be a number of difference scenarios developing off of this decision. The one you offer is, in my opinion, a little off the mark. I would expect that those surrendering will be given quarter…as our military is one of the most honorable on the planet. However, I doubt that the missions will remain geared towards acquiring intelligence if the ability to acquire that intelligence is compromised by the Supreme Court. In essence, if the other party wishes to surrender…they better be quick about it, because the opportunity will be scant.

    More likely, there will be new agreements with less squeamish countries to take over domiciling captured enemy combatants. Sub-contractors if you like. We do some of that already…I think this just increases the use of such techniques.

    Finally, I believe there will be a number of enemy combatants that just go…*pouf*…and will last be seen on the side of a milk carton.

    We should just get rid of the whole system of justice we were all told as kids was the greatest justice system in the world … and replace the whole thing with George Bush.

    That would be a lot easier.

    Wouldn’t that just be a lot simpler?

    I agree. I think putting a college ‘C’ student, with no intellect or understanding of the world, in charge of everything is a real good idea. Now, you’ll have to excuse me, tex, I’m gonna try to write my name in the dirt with my toes.

    Take your meds. It is not a war. War was only declared by the neocons and the Bush administration – not Congress. This is an illegal invasion and occupation of two countries which have never attacked us and would never be a threat to us. You are frightened out of your low IQ mind. I understand you feel the King can do no wrong. If that is how you feel, please move away from America. We don’t need whiny little babies living here.     Quick interrogation? Huh? How do we do that?

    Are you imagining that we ask them on the battlefield (or in their beds, which is where we catch them) “Hey, where’s Osama?” and then when they don’t answer right away, we shoot them?

    Why interrogate anyone at all, if we’re going to do that?

    But, you can’t be serious with that “quick interrogation” remark. Sort of like when my doctor lubes his finger and tells me that this will only feel uncomfortable for a moment — but then it actually tickles and feels good!!!

    I was going to say that I was for quick interrogations myself, but, ya’ know, from here I think I’d just like to follow the law, and the Geneva Conventions.

    Since you directed your sanctimonious drivel towards me personally, I’ll respond in kind…apologies to the wonder folks who run this site.

    I know exactly who Gordon Brown is, since he’s been PM of GB since June of last year. It would be rather difficult for me to have missed that little tidbit.

    But I suppose all them thar chores we’s gots to do down here’n BFE keeps my eggs all a’scrambled.

    I referred to you as “Mr” because it is a polite way of addressing another person. But you wouldn’t know that from inhaling all that cannabis sativa. I’ll refrain from doing so in the future.

    But, in more serious business, I would like to take this occasion to personally thank Jesus for all the wisdom he bequeathed (that means “handed down” for all you Southern folk) to the Supreme Court in making this courageous decision.

    And, Jesus, I’d like to humbly apologize for not being able to get Justices Scalia, Roberts or Thomas (you know, the tolken Black guy) to see your wisdom. They just won’t return my calls. What can ya’ do?

    I would also like to confess to coveting my neighbor’s wife, and coveting my neighbor’s Car, and coveting …. Well, to make this short lord, I want to confess to a lot of %^$#* coveting!!!

    You are correct, Warner — the most immediate and direct effect of this decision will be for American troops to stop taking prisoners. There’s no reason to take prisoners when the courts are going to free them in the next week. Shoot them while you can (because next they won’t be able to shoot them because they haven’t been read their Miranda rights).

    Hey come on, be fair, the Military Commissions Act was only struck down here by a measly single vote from the Supremes. There’s still plenty of time left to gut the Constitution and promote American exceptionalism while building the modern police state, it just takes patience and commitment. You just have to want it, it’ll come.

    lol, i love your cognitive dissonance. If our military was really that honorable, wouldn’t it abide by the obvious intent of its civilian masters? And yes, the military is absolutely subservient to all three branches of our federal government. If you don’t know that, brush up on your American history.
