Wait, doesn't the ACLU fight for the rights included in the Constitution? Can you explain why this kind of article would be on a site that wants to stop the ACLU?

Also, where does it say in the Constitution that all citizens have the right to project their "free speech" into the privacy of my home?

Mr. Dakin,

I have seen your web pages and, as I said, I am not a fan of Robocalls. And I certainly have no problem asking politicians to take a no robocall pledge. However, I have a major problem with monkeying with things that violate the Constitution.

Yes, modifying the law to include an opt in / out choice would be helpful.

However, many constitutional lawyers say that will still not hold muster RE: First Amendment.

While any attempt to rein in the abuses of robocalls is to be commended, the simple fact of the matter is that voters don’t want these types of regulations at all. What they want is for the phone to stop ringing.

Can you imagine the Federal Do Not Call registry, one of the most successful Federal regulations in history with 150 million numbers registered to date, limiting telemarketers to two calls a day?

The American consumer would have never stood for it? There would have been an uproar and it it would not have succeeded to the extent that it has.

I started a non-profit, non-partisan organization last year to combat intrusive robo-calls by using a voluntary, private sector solution: the Political Do Not Contact Registry. As a result I was asked to testify at the U.S. Senate by Senator Feinstein 2.27.2008 along with N.C. Attorney General Roy Cooper.

Our registry is similar to the federal government’s Do Not Call list. But to succeed it requires politicians who will honor the wishes of voters who’d rather not endure the endless robotic, political phone calls during campaign season.

Kansas Congresswoman Nancy Boyda was the second member to sign our pledge. She has taken the pledge and agreed not to robo call constituents that sign up for free at the National Political Do Not Contact Registry at StopPoliticalCalls.org. We commend her leadership on this important consumer issue that impacts the privacy of all voters.

We ask that all politicians join with us and take the “Do Not Robo call” pledge and stop the phone from ringing.

There is a much simpler way to block these calls, (And all other political calls as well), and it wouldn't violate the First Amendment.

Modify the law that created the Do Not Call list to include political calls with an opt in choice. If people want to get these calls they can simply check off a box and be annoyed to their hearts content.
