The U.S. 9th Circuit Court of Appeals is the government or at least part thereof. :-)

You meant the judicial branch agreed with the executive branches claim.  They are correct in their reasoning though I would use other words.  I wonder which 3 judges made the ruling though.  I am pretty sure they were not far left judges.</description>
