Cruel and unusual punishment was clearly defined at the time the cruel and unusual punishment clause became law. It simply meant that you would strangle a person before subjecting them to burning at the stake or being drawn and quartered. Waterboarding in fact was considered a just punishment for misdemeanor offenses. If Teddy wants to ban waterboarding then he and the rest of Congress need to pass a law to that effect.
