		<description>Christopher, yes the iranians can do that, and there is nothing to stop them.  But that shouldn&#039;t stop our government from chasing down terrorists.  If we had a real evil government they would have simply killed him instead of letting him go (if they were to do such a thing) but IF they did this they were nice enough to let him go and not just put a bullet in the back of his head.</description>

Can the Iranian government, who have now declared the United States a state sponsor of terror, abduct US citizens and send them to some remote island in the pacific for torture interrogation, due to belief that they might be a &quot;terrorist agent&quot;?  I rarely agree with the ACLU on anything, but they are right to assert that the U.S. cannot abduct citizens of foreign countries and subject them to torture and release them in the middle of no-where.  That is absurd.  The man needs his day in court.  Other than the fact that this is just appalling that we would do this, it is even sadder that we&#039;re trying to cover it up.  Americans are soon looking at the day when they can no longer leave the borders of their own country for fear that they will be abducted by foreign governments who no longer care to respect the Geneva Convention on the basis that if America doesn&#039;t adhere to it, they sure don&#039;t have to.</description>

If you believe that civil liberties only apply to US citizens, then you are asserting that our rights are not natural at all, but mere privileges extended by the state.

By the way, it&#039;s telling that the government did not dispute the plaintiff&#039;s account.  They merely asserted the right to bury the incident as a &quot;state secret&quot;.  To any reasonable observer, by even arguing the case in this manner the Bush administration has conceded that they do in fact engage in rendition and sponsor torture.

It&#039;s also worth noting that nowhere in the Constitution is the executive branch granted the authority to declare secrets at all.  The Congress is granted the power to declare its minutes secret, but the executive is given no such power.  That means that access to the federal courts is being cut off here on the basis of a power asserted without Constitutional basis.</description>
