How is it that in order to investigate terror cells in this country a Federal court needs to approve it but the democratic party(hillarious)can launch an investigation into one of its own(Obama) without it?

The premise of your question is wrong. You can investigate anyone for practically any reason. A court order is only necessary if you wish you perform investigative acts that would otherwise be illegal, such as trespassing or electronic eavesdropping.
