They are *not*, they are Acts of War and, thus, fall to the Military to prosecute. The only law enforcement against terrorism is Military law enforcement for foreigners. Committing an Act of War against the US as a Citizen has a different name. Treason. Defined right in the Constitution and *not* subject to questioning. I come at it from the opposite side and ask why are terrorist acts considered civil crimes? They are *not*, they are Acts of War and, thus, fall to the Military to prosecute. The only law enforcement against terrorism is Military law enforcement for foreigners.

Committing an Act of War against the US as a Citizen has a different name.

Treason.

Defined right in the Constitution and *not* subject to questioning.

This particular provision was added to that the French Resistance of WW2 would have been covered under Geneva Convention rules. IIRC, they wore armbands which could be thrown away when the fighting was over. But yes, the idea was that the fighters should be readily identifiable at a distance as viable targets. Just as a note- and many on the left don't know this either- our special operations soldiers, if they are disguised as the enemy or in civilian clothing, can be arrested as an illegal combantant, and tried. Usually, illegal combantants were tried in a field trial and then executed. This was done by both the Axis and Allies during WW2. As a note from a former soldier-
