The federal court was an activist court as it ignored both the U.S. Constitution and Supreme Court Precedent. The Supreme Court previously ruled that an person could be excluded because of his anti war viewpoint. The U.S. Constitution gives the government to act in the common defense and puts no limits on it as regards non citizens. Treaty and law passed by the federal government is the only limits that exist on non citizens and the later trumps the former.

I don't know anything about this guy, so I won't speak to the specifics of the case, but I think I can answer your question in more general terms.

The real question is why the ACLU wants this guy to teach his anti-American jihadist philosphies to our children.

Your choice of wording twists the situation in a subtle, but important way. The true question would be, "Why does the ACLU want to prevent the executive branch of our government from unilaterally preventing an ideological opponent from entering the country?"

Now, if this man truly does have a history of inciting violence, there is absolutely no reason to allow him in. If, on the other hand, he simply shares the same ideology as those that commit violent acts, we must be very careful before deciding to bar him.

You see, it's not his rights that I care about. What's really at stake here is our right to hear opposing viewpoints.

Again, I'll concede that I have no idea to what extent this man incites violence, but even if we assume that he does, I still support the ACLU's attempt to force the administration to bear some burden of proof.
