Bush signs legislation transferring Mt. Soledad to federal control

From the NY Times:

The transfer hardly resolves the dispute and instead may open another long legal chapter. Mr. Paulson and another man, Steve Trunk, have already filed papers in Federal District Court in San Diego to challenge the transfer and the presence of the cross on federal land as unconstitutional.
“It’s election-year politics,” said James E. McElroy, a lawyer for the men. Mr. McElroy said he had researched about 10 federal cases in which judges had ruled that Latin crosses could not stand on public property. “This is nothing new under the sun, and it is a waste of taxpayer money,” he said.

Oh, I guess McElroy forgot that in May, a judge ordered the cross torn down by August 1st. When immediate action is forced by a frivolous lawsuit like this, a politician shouldn’t carry that out in an election year because, what, it’s rude? Yes, no elected official should do anything during an election cycle. He’s just acknowledging what fringe kooks he, his organization and his client are with that statement.

    What happened to the days of Common Sense? Yes, coffee is hot. Memorials may have a cross, they have since the founding of the US. Idiots.

    Why should I care if it is election year or not. We have an election every two years so 50% of the time Acts brought before Congress can be blamed on election year politics. I have no clue what they blame them on the other 50% but I am sure they will come up with some excuse. Frankly all I care is whether not they do what I believe is right no matter what year it is.
