Actually letting a judge rule on the matter was a much better way of ending the controversy for them -- they wanted to establish the ID policy as unconstitutional and set a legal precedent. If you were being discriminated against, in a way that violated the Constitution, would you want to pay your own attorney's fees even when you'd proven your case in court? I doubt it.
