An Open Letter To The ACLU & Other Enemies of Freedom

GEORGE BUSH IS RIGHT!!!!!

Ok, now that we have THAT out of my system, let’s get down to business.

I just want to point out a couple of short things about this whole NSA “spying” business that the ACLU, among others, is trying to spin into some huge conflagration about Bush stomping on civil liberties, and we all live in a police state, yaddita taddita yaddita……it is all, put into words I can use on this site, Bull Durham.

First off this is an issue of serious legal depth, one which most honest lawyers will readily tell you takes a lot of knowledge about an obscure little thing called “American Constitutional Jurisprudence” that, honestly, gets really in depth, is apparently very nuanced and therefore, beyond the purview of most people around.

(on a side note, I know I mentioned “honest lawyers” earlier, and I know they are out there…..I just don’t think many of ‘em are allied with the ACLU, [glenn, this IS NOT a shot at you], so most of the ACLU lawyers are either dishonest, simpletons or seriously agenda driven cretins filled with a hatred of the American way and fully enamored of the lies of socialism….either way they are people you probably don’t want to meet for dinner)
Now, there is a blog called Release the Hounds, (coincidentally part of the stop the ACLU blogburst, but I have been reading him long before we started this endeavor), and he IS a lawyer, an honest one, a smart one and one that points out, while discussing the surveilling by Bush against the enemies of the Constitution he is protecting, that:

…it is abundantly clear that the weight of authority (daresay, the only precedent) supports the President”

Don’t believe me? Go read what he has to say for yourself, and then go read what John at Powerline blog has to say about this mess. John’s article concludes with this:

…The Times, in company with lots of other liberals, agrees that the administration is doing a good thing by intercepting international messages between al Qaeda terrorists and their agents in the U.S. Their only complaint is that in a relative handful of cases, they want the administration to follow a different procedure–a procedure which, on their telling, will not perceptibly encumber the administration’s ability to carry out the international surveillance in question. So their grievance is a technical one.

The problem is, you can’t base a technical legal argument on what you think the law ought to be. You can only base a technical legal argument on what the law actually is. And the current state of the law, as uniformly articulated by the federal courts, is that the NSA’s international surveillance program is a legal implementation of the President’s constitutional powers. So, technically speaking, the Times is simply wrong. Which leaves me wondering what the hyperventilating is all about.”

People that are much better versed in the realities of this situation, i.e. the LEGAL STANDARDS and DEFINITIONS have all been making cases that paint the liberals that are screaming against the wiretaps as idiots on one end, and treasonous, Freedom hating liars on the other, which only leaves the question that begs to be asked of you IF you side with the ACLU on this:

    SO are you saying that simply by dint of being a MILITARY LAWYER that the appelation of “honest lawyer” is a given?

    I view as suspect any collaboration with the ACLU by any group on any subject…..
