Graham Provision Approved

Thursday the United States Senate approved an amendment to an upcoming Defense Policy Bill which eliminates the ability of detainees at Guantanamo Bay to sue in federal court challenging their detainment.

The provision authored by Senator Lindsey Graham (R – SC) would grant 1 appeal to the DC Circuit Court of Appeals to challenge their status as “enemy combatants” but not to file writs of habeas corpus challenging the legality of their detainment in any federal court. The Senate voted 49-42 to approve the including of the provision in the Defense Policy Bill.

This provision was authored as a response to a recent Supreme Court decision which allowed the detainees being held at Guantanamo Bay to petition the court for writs of habeas corpus challenging the legality of their detention.

“For 200 years, ladies and gentlemen, in the law of armed conflict, no nation has given an enemy combatant, a terrorist, an al-Qaida member the ability to go into every federal court in this United States and sue the people that are fighting the war for us,” Graham told his colleagues.

Democrats on the hill have already begun to cry foul. Senator Jeff Bingamen (D – NM) began his crying by saying that the provision was a major mistake and deserved scrutiny. “It’s contrary to the way the court decisions have come down already. It is an extraordinary step for this Congress to be taking,” he said.

Five Democrats sided with 44 Republicans to approve including the provision in the upcoming Defense Policy Bill. And 42 United States Senators voted to continue allowing terrorists to abuse our legal system in order to carry out their war against our nation and it’s people. Including Senators Chafee (R – RI), Specter (R – PA), and Smith (R – OR); with 7 other Republican Senators and 2 Democrats who weren’t present for the vote.

    Bout time someone seen what the slimballs are doing. Maybe we have something going. Also with the Bill that is pending reference the boy scouts.
