Supreme Court Nominee Short List
Posted on October 30, 2005
Fox News hyped me all up that Bush might announce his pick for Supreme Court. He didn’t. The rumor is that he will announce it between now, and Tuesday. Most people think it will be sooner than later. I’ve done a little research on the nominees, and here is what most people think the short list includes. There are several others out there, but most rumors seem to narrow it down to these.

This one seems to be the favorite with many. He is 55, and a judge on the U.S. Circuit Court of Appeals for the 3rd Circuit. He has voted to uphold regulations on abortion, and ruled against the ACLU on Establishment Clause cases in the past. Alito wrote for the majority in 1997 in finding that Jersey City officials did not violate the Constitution with a holiday display that included a creche, a menorah and secular symbols of the Christmas season. This would be a good pick, would satisfy the base, and would cause a huge fight with the democrats. Nicknamed Scalito after his judicial philosphy resembling that of Scalia.

Luttig is 51, has been a favorite in conservative legal circles for decades, going back to his clerkship for then-Judge Antonin Scalia on the U.S. Court of Appeals for the D.C. Circuit in 1982-83. He did, however, help get Souter confirmed. Overall, a good pick that would satisfy the base, and cause a fight with democrats.
3. Priscilla Owen

Has been criticized as being on the “far right wing” of the Texas court, further to the right than Bush’s own appointees to that court when he was governor. Supported the elimination and narrowing of buffer zones around reproductive health care clinics in Houston. I got this information from NOW’s website. They are already prepared to fight if she gets it. In short, if NOW doesn’t like her, she’s gotta be a good pick.
4. Edith Jones

Edith Hollan Jones (born in Philadelphia, Pennsylvania, 1949) is a judge on the United States Court of Appeals for the Fifth Circuit.
Jones graduated from Cornell University in 1971. She received her J.D. from the University of Texas School of Law in 1974. She was in private practice in Houston, Texas from 1974 until 1985, working for the firm of Andrews, Kurth, Campbell & Jones, where she became the firm’s first female partner. She specialized in bankruptcy law. She also served as General Counsel for the Republican Party of Texas from 1982-83. She’s been very critical of the decision made in Roe Vs. Wade. This pick would definitely bring a fight from the democrats. If Bush picks her, expect to hear phrases like, “turning back the clock on fundamently rights.” The democrats hold the “right” to kill babies very close.
5. Janice Brown

Another favorite among conservatives. I’ve heard this name over, and over around the blogosphere. Justice Brown Has Significant Judicial Experience. “Since May 2, 1996, Janice Brown has been an Associate Justice of the California Supreme Court. From November 4, 1994, she was an Associate Justice of the Third District Court of Appeal in Sacramento.” This one will definitely satisfy the conservative base, as well as start a fight with the democrats.
There are a few other names out there, but these seem to be the most likely picks. The rumor mills are tossing these five names around the most. Any of these picks would be good choices. In the rumor mills, they are also very likely. If Bush picks any of these it is pretty obvious that the conservative base will be happy, and the democrats will cry. Looks like the fight that many were wanting will happen.
Underneath Their Robes think its coming down to either Alito or Luttig.

After reading an article in the local paper, my money is on Luttig, since he is a tad bit younger then Alito. Though I still want Brown, just to see the Lefties go ultra moonbat in attacking a Black woman.
I’d be more than happy with Alito or Owen, but as I’ve said before, our senators haven’t shown much willingness to fight for any of Bush’s previous far right picks, which is why I think he’s gotten into stealth candidates: He didn’t want to give them anyone who’ll require a fight.
Now he can give them someone like Owen, and they damn well better fight, no matter how bloody it gets, or keep still if the next nominee is Minnie Ha Ha.
I agree Seth, completely.
Since the MSM is saying Alito or Luttig, I will go with Williams again.
MSM hasn’t been close yet!
Batchelder?
Washington Post:
“Judging by the names the White House floated by political allies in recent days, Bush seems ready to pick a candidate with a long track record of conservative jurisprudence — one who would mollify the Republican base, whose opposition to Miers’s nomination helped scuttle her chances. Several GOP strategists said the most likely choice seemed to be federal appeals judge Samuel A. Alito Jr., with judges J. Michael Luttig and Alice M. Batchelder also in the running.”

Excerpt:
“In the presidential debate last year at Washington University, candidate George W. Bush explained his philosophy for picking judges. He announced that he would select individuals “who would not allow their personal opinion[s] to get in the way of the law” — individuals who would interpret the Constitution, rather than legislate from the bench. With Justice Sandra Day O’Connor’s retirement, we have the first high-stakes test of President Bush’s promise. To fulfill this promise, President Bush could do no better than to appoint one of the less-known jurists whose name recently has been bandied about in the press: Judge Alice Batchelder — a judge who has made a career of applying the law rather than imposing her own policy preferences.”
