Schumer says Miers Lacks The Votes To Be Confirmed

WASHINGTON (AP) – A Democrat on the Senate committee that will consider Harriet Miers’ nomination said Sunday that President Bush’s Supreme Court choice lacks the votes now to be confirmed, saying there are too many questions about her qualifications.

“If you held the vote today, she would not get a majority either in the Judiciary Committee or the floor,” said Sen. Charles Schumer, D-New York. On the 18-member GOP-controlled committee, “there are one or two who said they’d support her as of now.”Source

I’m pretty certain, though no fan of Schumer, that he is correct on this. I still trust Bush that she may have been a good pick, but in some ways she wasn’t a good pick. I don’t like how it divided the base at all. Perhaps if they withdraw her, they will put someone up that will satisfy the base, give them the fight they want, and still get confirmed. But has this nomination weakened the political capital of Bush to the point that a big fight for a justice that resembles the philosphy of Scalia more, and has a record enough to show it get through the fight? Quite interesting how this has unfolded politically, and it looks to continue to be interesting. Its hard for me to see Bush withdrawing her. That is just judging from the history of his personality. We’ll see though.
