Last push for petition on ACLU fees — let’s stop the extortion racket

As I write this, the online petition to change federal law (specifically 42 USC section 1988) has 16,243 signatures. The petition is designed to encourage Congress to put an end to the abused and misused mechanism in the law as its been written since 1976, by which the ACLU (and like-minded groups) often get large awards of attorney’s fees for suing town after town and city after city over things like displays of the Ten Commandments, or a Christmas display. The threat of a likely award of attorney’s fees under 42 USC 1988 before judges friendly to the ACLU often causes local governments to cave to the ACLU without a fight, even when public interest law firms offer to defend the cities for free (a good example is what happened in the case of the L.A. County seal).

Sixteen thousand signatures is not enough. Actually, once duplicate and illegitimate signatures are purged, the total will be more like fifteen thousand. I think that the reason there aren’t more signatures is because people want to do the right thing, but get turned off by legalese and phrases like “42 USC 1988″.

CourtZero started the petition last November, and since then the petition has been mentioned by radio host Roger Hedgecock while subbing for Rush Limbaugh, and written up at WorldNetDaily twice (here, and here).

Despite the fact that a bill was introduced in Congress by Congressman Hostettler of Indiana in May of 2005, that would do precisely what the petition asks for, the rate of new signatures on the petition has waned to about 50 a week. We need to do better.

The amazing and rather startling rise of StopTheACLU.com, this remarkable website/blog (and Jay, I am truly impressed) presents one last shot at organizing this effort. Please look at the petition, sign it if you agree, and spread it around. Now that we have a bill filed in Congress that squarely addresses what I think of as the ACLU’s extortion racket with respect to attorney’s fees in their endless and destructive Establishment Clause lawsuits, and now that we have this growing and robust blog, let’s give it another try.

What do you say? Let’s double this thing, get to over 30,000 signatures, and then we can go to Congressman Hostettler with some real credibility. The petition is here.

    Hurray for the ACLU and their willingness to hold people accountable. They’re fighting for your rights too. You better pray to whatever God you’re trying to foist on all of us that you don’t ever need their services. Of course, if you keep down the road you’re on, you just might.

    No thank you Joe. If I need legal services I will go to someone I trust like the ADF or ACLJ someone who will help me get my civil rights back so that I may pray where the bible tells me to, not where some athiest judge tells me to.

    Thank you for challenging a group in the ACLU that is the equivalent of the Viet Cong of the 60’s and 70’s. No they do not kill people but they try to find ways to undermine the will of the majority as well as fighting anything that relate to God in the public square. Their hatred for freedom of religion is well-documented and the way that they sue Christians and the Boyscouts should appall every American in this country. These guys should be stopped and until someone has the moral clarity to challenge them they will continue to strip us of our identity which is God, the creator.
