Lawyers for the American Civil Liberties Union are appealing the conviction of an Easton woman who was accused of endangering a child by using cocaine while she was pregnant.
Kelly Cruz, 30, was found guilty of a reckless endangerment charge Aug. 5 after waiving her right to a jury trial. She was ordered to serve 2 1/2 years in prison.
Cruz was charged in February, about a month after giving birth to a premature baby boy who tested positive for cocaine.
Defense attorneys had sought an acquittal, arguing there was never a risk of harm to another person — because a fetus doesn’t meet the definition of a person under state law. But a Talbot County judge ruled that the person who suffered the risk was the baby after it was born.Source
Aaah! The old fetus is not a person argument. Should have figured. It isn’t a new strategy.
A social conception of freedom closely ties rights to responsiblities and holds wrongdoers accountable for their actions. But the ACLU rejects such a position, even in extreme cases. When Jennifer Johnson, a 25year old woman, gave birth to her third drug-inflicted baby, she was sentenced to 14 years probation and participation in a drug treatment program, over the objections to the ACLU. The Union argued in 1991 that the concaine-using recidivist should not be held accountable for the damage done to her child and protested vehemently when a judge ordered Ms. Johnson to use Norplant, a long-term birth control implant. The ACLU is trying to transfer the true victim here to a meaningless parasite not worthy of rights or life, and trying to say the drug abuser is the victim. It is one of the sick and twisted legal maneuvers they have gotten quite well at doing. It isn’t new to the ACLU, and you will always see them disregard responsibility in favor of unlimited rights in an almost anarchist fashion. The ACLU is completely backwards in this view and blindly idealistic to the point they ignore the very responsiblities that protect our rights. Can someone please shut them down already? This little helpless unborn baby is dependent on this this addict, and now will be dependent on the drugs they used. Does the ACLU care? Of course not.
For those wanting to know specifically what problem I have with the ACLU this is a good example. They stand for rights without responsibilities. Even rights over responsibilities.

I had to change positions because I was so sickened and angered by mothers using drugs giving birth to babies. In one week alone of the 10 mothers I had to care for, seven of them had their babies taken away from them by the Department of Health Serices after the babies tested positive for drugs. There is nothing more infuriating in the world than to have some freaking drugged out mom, crying and carrying on that the “law” took her baby from her and how unfair it was. Or to listen to them whine that all the doctors give them for pain is tylenol.
The whole reason why the ACLU doesn’t see a fetus as being a human being is becuase of the whole evolution teachings. To them it would just be killing off a fetus of an animal. I love your posts ^^ I can’t tear myself away from this site.
This woman should lose custody of the child permanantly. She is sick in the head and selfish to endanger her baby like this.

Why can’t the people of the United States, via a good law firm, file a class action law suit against the ACLU for sucking the money out of us every time they win a bogus lawsuit? Or treason for giving comfort and aid to the enemy on a regular basis and trying to give AMERICAN rights and due process to non-Americans, even terrorists (GITMO)?
The ACLU and others like them, are going to destroy this country from within, just like Bin Laden is hoping for.
The State of Maryland rejected back in 1990 to recognize a fetus as a person — even California recognizes a fetus as a person, hence the Scott Peterson conviction.
But for the state to convict a woman based on a legal definition that was specifically rejected back in 1990 is highly suspect. Just because this is judicial activism in your favor doesn’t make it anymore right.
The baby was born Mark, it was no longer a fetus – enough already of your hocus pocus turn on words – born with drugs in it’s system after testing done immediately after delivery which is standard procedure in any delivery. Once that baby hit the hands of the OB physician the baby became a person and is entitled to the same rights as everyone. Including being free from drugs being pushed on him from a drug user. Even if it was prior to birth.

I agree with gitardood, we ought to organize one giantic collective law suit against the ACLU for grievances occured at the damage they have done to our constitutional rights and freedom. If we can get a really good settlement, it should bankrupt this communist organization and make it harder for them to proceed with hijacking of justice and truth antics in the court rooms across this country.

I contend that they are not idealistic at all. These are not just a group of stupid, pie in the sky lawyers who mean well. They know very well what they are doing.
They are a communist organization of snakes, who use catchphrases of the free society (that they wish to destroy and replace with communism) to hide behind. (i.e. “American” “Civil Liberties”, “Freedom of Speech” etc.)
They cleverly use such rights as Freedom of Speech, to destroy our very rights of Freedom of Speech. They use our right to Freedom of Religion to take away our right to Freedom of Religion.
I wish the true American patriots out there could unite and shut these communists up permanently, or at least reduce their influence down to the level of the influence and relevance that groups like the KKK have.

Good point Dethanial – I AGREE WITH YOU – but for the sake of the uninformed I was trying to give him the benefit of a doubt and educate him a bit to at least what the ACLU identifies a person as being.

Mark, if you are just arguing for the sake of arguing…well that can get quite annoying. Gribbit, I really don’t think this guy is a threat to my thoughts enough to make a big deal over. He may be a little paranoid in your opinion for “hiding” or remaining anonymous, but some people are just like that. But…what happens between you two, is between you two, and from here on out…I’ll stay out.

I’ve been out of town for a few days so I apologize for not responding sooner.
Jay: I’m not arguing just for the sake of arguing. We either obey the laws as written or we allow judges and prosecutors to get creative with the law to achieve our desired outcome. The latter is judicial activism which is often derided by the Republicans.
Criminal acts are judged at the time they were committed not at the time the crime is detected or the accused is caught. Ms. Cruz’s bad act happened the moment the cocaine entered her bloodstream while pregnant. The fact that the bad act wasn’t detected until Ms. Cruz gave birth doesn’t change the time when the act occurred.
It’s perfectly fine to argue that Maryland law is wrong and should extend child protection laws to the mother’s womb. But that isn’t current Maryland law and to encourage a prosecutor and judge to go outside current law or creatively interpret current law is judicial activism of the worst kind.
